AMY'S LAW: FAILURE TO CALL 000 SHOULD BE A CRIME
The issue
My daughter Amy Bowden was killed by her partner on the February 8, 2024. He chose to inject her with drugs rather than get medical help, an action that most likely would have been lifesaving. He was only sentenced to nine months jail .
I am calling on the South Australia Australian Premier and Attorney General to introduce Amy’s Law, which will make it a serious crime and provide tougher sentencing options for people who fail to call 000 when someone is dire need of help.
I am also calling for legislation around duty of care to be re evaluated as a result of my daughter’s case. The duty of care in South Australia applies between an adult and a child, and a carer to an elderly infirm or person with disability. It does not apply between partner to partner, which I think is beyond belief. We need an extension of duty of care to ensure innocent victims like my daughter get appropriate justice.
ONE PHONE CALL WOULD HAVE SAVED MY DAUGHTER
Ethan Ross was only charged with administration of a drug in relation to my daughter’s death. What he did that day equates to far more than that.
He held my daughter’s life in his hands for almost 24 hours before calling 000.
Amy was completely at his mercy, she was unable to protect herself.
Ross called me that morning of her passing and handed me straight over to the paramedics who told me they could not revive my baby, Amy Bowden.
My life and many others shattered that day, forever changed.
Ross also messaged and said that it wasn’t his fault and that she was his soulmate. Who would leave their soulmate unconscious on the floor for 24 hours?
Other states and territories have stronger laws which serve to protect the victim.
In the ACT, for example, Christopher Weaver injected his partner with heroin at her request.
She fell ill and this man actually called an ambulance and commenced CPR, but she she could not be revived.
This man has been charged with manslaughter. He showed so much more care for his partner than Ross did. Ross only faced a minor charge for something that involves so much more neglect and disregard for life.
Our family will forever be haunted by the fact that he treated our daughter’s life as less valuable than the cost of an ambulance. Amy deserved so much more than to be treated with such callousness and disregard.
