Ammend Outdated Datum Date Laws to Protect Long-Term Occupants in Maharashtra

The Issue

We, the occupants of Dahisar Shukla Compound, have lived and worked in our properties for decades, some even with proof of existence before 1992. Despite providing substantial evidence like electricity bills, telephone bills, and Central Excise certificates, Census receipts year 2000 and others, many of our commercial units have been unlawfully demolished by the BMC. Meanwhile, newer occupants or slum dwellers with proof as recent as 2011 are granted legal status. This discriminatory practice is destroying livelihoods and violating our constitutional rights.

 

 

 

Outdated Datum date laws, originally intended to protect property rights, are now being misused by builders and authorities to evict lawful occupants without due process. This is not only unfair but unconstitutional:

 

 

 

Article 14 of the Constitution of India guarantees equality before the law and mandates that similarly situated persons be treated alike.
Article 21 of the Constitution of India ensures the right to life and personal liberty, which courts have interpreted to include dignified living, shelter, and protection from arbitrary deprivation.

 

 

 

Courts have consistently held that even “encroachers” cannot be evicted without notice, alternatives, or rehabilitation. Yet lawful property owners, who have decades of documented possession, are being denied justice.

 

 

 

We demand that the Maharashtra State Government:

 

 

 

1. Review and amend outdated Datum date laws to reflect contemporary property realities.
2. Ensure fair and non-discriminatory treatment of all occupants, regardless of when they acquired their property.
3.Protect lawful property owners from arbitrary demolition and eviction, while facilitating responsible urban development.
