Investigations do not belong in the hands of the officer pulling the trigger!
The Issue
It is a critical time in the history of the United States of America, as public trust in Law Enforcement, State agencies, and Judicial practices are swaying towards criminal enterprise is rapidly falling without the ability to hold those with Qualified Immunity accountable. Such travesties of justice such as the shooting of unarmed Ohioans must be investigated and not left to the simple the narrative of the officer pulling the trigger; however that is exactly what has transpired in the case against Mr. Jerry Smith on March 28, 2020 when the shooting officer took nearly 54 days to charge Mr. Smith with Attempted Aggravated Robbery after BCI failed to investigate and conclude their findings. This type of egregious error gives the misrepresentation of criminal behavior through the Sheriff's Department.
On March 28, 2020 a Press Release was given by Clermont County Sheriff’s Department that a man had been shot multiple times during a home invasion and in critical care at University of Cincinnati after a home invasion and that Clermont had requested BCI investigate the incident.
Today nearly 16 months later BCI Agent Dave Horniyak and his team have yet to conclude the investigation. Although they broke the chain of custody by returning any evidentiary findings back to Clermont County Sheriff and they failed to use the resources such as scientific, forensic, procedural, or manually required investigative tactics they failed to meet their obligation into being the “State of Ohio Investigative Independent Fact Finders”.
as of today BCI has yet to do it’s assigned, requested job.
I have called BCI Agent Horniyak's department to find out why they failed to investigate the shooting of an unarmed citizen. During this time I have found that it is impossible to contact supervisors, directors, or the Attorney General’s Office to make an inquiry, complaint, or receive an answer on why BCI failed to fulfill its obligation to the citizens of Ohio. At one point I had a return call from Will Jones impersonating the Assistant Deputy Director asking what my complaint to the DOJ had been and what my concerns were regarding Agent Horniyak, another call came from Investigator Barbosa who stated that he would pass the information onto Horniyak's supervisor. Ohio BCI failing to conclude investigations they have been requested to, proves that they are not interested in being the investigative fact finder.
I ask Governor DeWine to intervene and request the FBI to investigate as this case has never been investigated and there are many unanswered questions into an unarmed American Citizen being shot five times within 10 seconds after the Deputy exited her vehicle and to finally have a conclusive finding into the incident and to complete the request BCI failed to conclude.
