Amend Virginia Code to Provide Fair Tax Relief for Disabled Veterans

The Issue

Veterans living in Virginia with a disability rating under 100%, find themselves caught in a system that unjustly penalizes those who are not rated 100% disabled. Veterans of all disability ratings face significant financial and physical challenges every day. Under the current Virginia laws—specifically Code of Virginia § 58.1-3219.5 & § 58.1-3668— Disabled veterans with disability ratings less than 100% receive zero property tax relief, unlike their counterparts who are rated at 100% disabled. This stark disparity creates what is known as an unfair "benefits cliff," a situation where veterans with less than 100% disability ratings are denied essential financial relief.

The issue at hand is not just about numbers on a page but the real impact on the lives of those who have served our country. Veterans who are 90% disabled and below endure many of the same hardships as those rated at 100%, including ongoing medical expenses, loss of income, and additional costs related to daily living and mobility. The current policy fails to recognize these realities and, as a result, places an undue financial burden on many veterans who have given so much in service to our nation.

Our proposal is straightforward and fair: amend the Code of Virginia to provide property tax relief that is proportional to each veteran's VA disability rating. This change will eliminate the gap that disproportionately affects those with a disability rating of less than 100%. It is a measure that would acknowledge and honor the sacrifices of all disabled veterans, ensuring they receive the support they need to lead dignified lives.

Statistics from reputable sources demonstrate the urgent need for reform. According to the U.S. Census Bureau, there are thousands of veterans with varying disability ratings living in Virginia. Each one of these veterans faces the potential financial instability not covered by current legislation. Moreover, numerous studies have indicated that financial stress significantly impacts physical health, meaning comprehensive relief not only aids financial stability but also promotes better health outcomes for our veterans.

We call upon lawmakers and officials in the Commonwealth of Virginia to address this critical issue. By amending the existing laws to offer proportional tax relief, we can ensure equity and fairness.
