The Issue

Speeding is a common offense on Florida's roads, often leading to arrests and a criminal record that can severely impact drivers' lives. However, rather than focusing on rehabilitation or safety, the current system primarily punishes individuals without offering a constructive solution. By decriminalizing speeding and instead imposing significant financial fines, Florida can alleviate the burden on its justice system while still holding offenders accountable. The current Super Speeder Law states that going 50MPH over the speed limit or speed exceeding 100MPH will lead to an arrest and a criminal record. We ask that the state reconsider the punishments as this will create a great deal of criminal records for people who are otherwise functional and contributing members of society. Criminal records, no matter how minor, greatly prohibit people from achieving employment. We ask that the state of Florida amend the law to a financial penalty of $5000 with points, no arrest, and no impounding of the vehicle when an offence is committed on highways and interstates. Local residential roads should continue to be enforced as is.  

Firstly, it's important to note that incarceration rates in Florida are at an all-time high, straining resources and taxpayer dollars. According to the Florida Department of Corrections, the state's correctional facilities are already overpopulated, with many inmates serving time for non-violent offenses such as speeding. By shifting towards financial penalties rather than arrests, Florida can reduce its incarceration numbers significantly.

Moreover, significant financial fines would not only dissuade drivers from speeding but also generate revenue for the state. These funds could be redirected to more constructive societal needs such as road safety programs and infrastructure improvements. Studies have shown that enhancing road safety through better infrastructure and public awareness reduces accidents more effectively than punitive measures.

In other states where speeding has been decriminalized, such as California, there has been a noticeable decrease in administrative costs related to processing these cases, allowing law enforcement to focus on more severe crimes. Florida could benefit similarly by refocusing its resources towards maintaining public safety and addressing serious criminal activities.

Lastly, adopting a system of significant financial penalties aligns with a more progressive approach to justice. It allows individuals to learn from their mistakes without bearing the lifelong burden of a criminal record that can affect their employment and social opportunities.
