Amend the Dreaming Summit HOA Parking Rule in Light of Arizona Law HB-2298

The Issue

We, like many in the Dreaming Summit neighborhood, are a family of five. We have two working parents and three children who are all licensed drivers, using their own vehicles to commute for high school, work, and college. With only enough room to park half of our vehicles driveway, we often use street parking as an alternative. This has unfortunately led to nearly daily citations recently due to a recent change in the Homeowners Association (HOA) rules.

Currently, the HOA allows for homeowners to be cited for any street parking, whether it be in front of our home or common street areas, based on Arizona law HB-2298. This regulation has unfairly targeted families with multiple vehicles, causing undue stress and unnecessary financial burden. Prior to this change, common areas were generally used for overflow parking with no issue.

According to the law, HOA boards have attempted to regulate speed and parking by issuing citations to homeowners, yet this one-size-fits-all rule doesn't take into account the unique circumstances of different families in the Dreaming Summit neighborhood. The constant issuing of citations is not a sustainable or neighborly solution.

For the sake of equitable treatment and community harmony in Dreaming Summit, we propose an amendment to the current HOA parking rule to be fair for all residents, taking into consideration the specific needs for larger families or families with multiple vehicles. This is a request for a more flexible, understanding, and community-driven approach to address this matter.
