Amend RCW 26.44.030 for clearer reporting guidelines
The Issue
In the complex world of child welfare, clarity and nuance are vital. As Master of Social Work students advocating for equity, social justice, and human rights, we are driven by a commitment to improve and protect the lives of vulnerable children and families. This mission is deeply personal as we witness the overrepresentation of Native American/Alaska Native and Black families in the child welfare system, a reminder of persistent inequities and systemic bias.
Currently, RCW 26.44.030 mandates that when a mandated reporter "has reasonable cause to believe that a child has suffered abuse or neglect…he or she shall report such incident, or cause a report to be made." This well-intentioned legislation aims to protect children, but its current wording inadvertently contributes to over-reporting.
To reduce the overrepresentation of Native American/Alaska Native and Black families in child welfare, the RCW should also include requirements that mandated reporters reflect on potential bias and systemic factors prior to reporting. The “reasonable cause” standard lacks guidance on how structural inequities such as poverty, limited access to services and systemic racism can be misinterpreted as neglect.
Amending the RCW to differentiate between willful neglect and inability to provide basic needs, and adding language to encourage consideration of implicit bias, would create a more precise and equitable reporting standard. Thus, reducing unnecessary involvement with child welfare, promoting equity, and allowing child welfare agencies to focus on children facing genuine risk of harm.
Our proposed revisions aim to reduce the harm of over-reporting on already marginalized communities while still safeguarding children from life-threatening situations.
