The Issue

The new requirement set forth by the Alberta government, mandating the "Employer Declaration and Authorization Form" for provincial nomination programs, is creating substantial challenges for Intra-Company transfer employees holding LMIA exempted positions. This form has become a mandatory document for the program. However, most publicly listed companies, due to their corporate policies and regulations, are reluctant to provide such a document, leaving numerous skilled professionals in jeopardy.

Particularly affected are those in LMIA exempted high-wage jobs, contributing significantly to businesses and the local economy. Many of these employees are invaluable assets to their companies and bring a wealth of expertise and economic benefit to Alberta. Unfortunately, the inability to secure this form is hindering their career progression and jeopardizing their residency status.

A practical and fair solution would be to permit the submission of alternative documents for these high-wage jobs. We propose allowing the employees to submit their employer’s audited financial statements in lieu of the "Employer Declaration and Authorization Form." These financial statements are credible, legally compliant, and publicly available for listed companies, thus maintaining the transparency and integrity of the nomination process.

Such a measure would ensure that Alberta continues to attract and retain top international talent, crucial for the province's economic growth and competitiveness. It would also respect the corporate policies of publicly listed companies, while protecting the careers and lives of skilled professionals who have chosen Alberta as their home.

We appeal to the Alberta government to consider revising the requirement and provide alternative options for LMIA exempted positions with high wages. This change not only aligns with global business practices but also supports the objectives of Alberta's skilled workers' program.
