The Issue

I am creating this petition because I have recently personally experienced the devastating impact of a flawed justice system.

In my case, the perpetrator was found not guilty despite TWO victims coming forward with reports on the same day from different locations, not knowing each other.
The investigation was hindered because the police could not access the suspect's phone  before the trial, to find crucial evidence  that could have led to a conviction.

In the digital age, smartphones have become an essential part of our lives, often holding key evidence that can be pivotal in criminal investigations. However, current laws and technological barriers often prevent law enforcement agencies from accessing this evidence. This legal and procedural loophole has allowed many guilty individuals to walk free, and justice to be denied to victims.

According to a report by the National Institute of Justice, digital evidence plays a significant role in 96% of all crime investigations. Yet, court rulings and privacy concerns often restrict access, leaving investigators with limited resources to piece together a complete narrative. This gap in our justice system not only affects victim's lives like mine but also undermines public safety.

I'm calling for a legislative change that allows police to access a suspect's phone when there is reasonable suspicion of criminal activity. By employing robust oversight mechanisms and judicial approvals, we can ensure this access respects individual privacy while also serving the greater need for justice.

Several countries have already adopted guided frameworks that balance privacy rights with the necessity of obtaining digital evidence in criminal cases. For example, the European Union's General Data Protection Regulation (GDPR) allows for stringent data protection, yet offers provisions for law enforcement to access digital data under specific conditions. We can learn from these approaches and implement similar measures in our jurisdiction.

Victims deserve justice, and perpetrators should not find refuge in technology that hinders lawful investigations. It is time to recalibrate our approach so that justice can be served more effectively.

I urge lawmakers to act now and support initiatives that ensure law enforcement can access encrypted or locked data on phones when pertaining to criminal investigations. Join me in making this change for a safer and fairer justice system.

Please sign this petition to call for legislative reform that will give law enforcement the tools they need to conduct thorough and fair investigations.
