The Issue

My son is 17 years old, and he faces challenges every day due to his special educational needs (SEND) and mental health issues. Unfortunately, the current system in the UK doesn’t adequately protect him. At 16, a person is legally deemed to have the capacity to refuse medical, mental health, and social care support, as well as face a change from Disability Living Allowance (DLA) to Personal Independence Payment (PIP). This abrupt transition can have severe consequences for young individuals who are not yet ready to make these critical decisions on their own.

For many children with SEND, learning disabilities, or mental health issues, the age of 16 does not mark the beginning of adulthood. The gap between the statutory right to continue receiving the appropriate healthcare and social support services until they are truly adults is leaving many vulnerable young individuals like my son without the support they desperately need.

While some 16-year-olds are capable of making informed decisions, the current standard does not accommodate those who, due to their unique challenges, are not ready to handle such responsibilities. The discrepancies between NHS service, social care, and benefits that stop at 16 can lead to tragic outcomes for those like my son who fall through the gaps when they need help the most.

We urge policymakers to align the age thresholds of NHS services, social care, and benefits to 18, when young individuals are legally recognized as adults in the United Kingdom. This alignment will help ensure that all children, especially those with SEND and mental health issues, continue to receive the necessary support without the risk of losing benefits or assistance.

By extending the age at which children can access these essential services, we can provide a safety net for our most vulnerable youths, ensuring they transition smoothly into adulthood with the support they need. It's time we rethink and reform policies to ensure our children's well-being and future.

Please join me in urging the UK government to take this important step in safeguarding the health and rights of our children by signing this petition. Together, we can create a support system that truly reflects the needs of our youth and provides them with a fair chance at a better future.
