A Motion to Dismiss the Save Ruby Meadow lawsuit has been filed by Alameda County and Eden Housing, Inc. (a private nonprofit and conglomerate of for-profit and nonprofit affiliates). It will be heard by Judge Roesch on Thursday May 27th, 2021 at 3:30 PM. You are welcome to bear witness and attend the online hearing. If the Judge grants the dismissal, Ruby Meadow is once again vulnerable to the massive environmental and cultural destruction Eden Housing plans and Alameda County approved. The most flagrant and disgusting factor is that they did not file their Motion to Dismiss because they are innocent of violating the law; rather, they filed their motion based on procedural mistakes the community volunteer made in service technique and missing internal deadlines. Be aware if you ever file a civil lawsuit that the first service must be done IN PERSON unless the defendant agrees in writing to accept the notice by mail, even if it is a pandemic. If the judge does not grant their motion, we have finally identified several attorneys who will potentially represent Save Ruby Meadow through the rest of our lawsuit.

The saddest part is that we don't want to block new housing--we just can't stand by doing nothing as this precious Ruby Meadow is chainsawed down and dug up. We have too many vacant lots and buildings right here in the same neighborhood that should built up first!!! The meadow remains the traditional home to many of our winged, furred, and shelled friends. We recognize Ruby Meadow as a peaceful sanctuary for all and as a sacred creekside site of Ohlone gathering and joy for centuries.
