Dear neighbors,

I recently posted an update with a go fund me link. Our group is pursuing legal action to challenge Charleston County’s decision to approve the use of a PD for a billboard (single use does not meet the standard of mixed use development according to the SC planning and enabling act). If each person could contribute even a small amount, this would help. This has unfortunately become a legal issue because our County is not adhering to the law. In the words of our attorney:

“The Planned Development tool is a powerful one because it allows a landowner or developer to literally write their own zoning rules. For that reason, the General Assembly imposed strict limitations, for example, the requirement for mixed use.

The County's enactment of a single use PD, that just has the effect of navigating around the variance process, subverts the will of the legislature and sets a terrible precedent.”
