
A Grand jury has been designated to investigate Elijah McClain’s death by Aurora officials. It is unclear what this ultimately means for his case. Potential upsides are that a grand jury has the power to demand evidence that may otherwise not be available.
The downsides? The process lacks transparency, allowing things to be hidden from the public, and prosecutors have “considerable influence in whether a grand jury recommends criminal charges.”
“Prosecutors are not required to use a grand jury and don’t in most cases, so we are forced to question whether this is yet another example of law enforcement being held to a different standard than every other person being investigated for murder. Prosecutors frequently use grand juries as a way to pass the buck, steering the grand jury to decline to bring charges, or to bring only minor charges,” stated the McClain Family lawyer.
We will continue to be vigilant in monitoring progress on this case to ensure that we see justice through. In the meantime, we direct our attention to the 1/21 & 2/1-2 hearings for dangerous Aurora police officers looking to get their jobs back.
