ACTION TO ADDRESS SMOKE INFILTRATION IN BURNABY, BC APARTMENTS AND CONDOMINIUMS
The Issue
Many residents of Burnaby, B.C. apartments, condos and town-homes have been concerned about the health impacts of the long term exposure to second-hand smoke migrating from neighbouring units.
There is no known safe level of exposure to second-hand smoke, and many of the undersigned continue to experience smoke infiltrating into their homes on a frequent and on-going basis within this particular apartment complex.
Despite many buildings supposedly having strict no-smoking policies (many of which also includes disallowing the use of marijuana), as well as signage throughout the buildings stating that they are non-smoking properties, many residents of continue to defy the no-smoking rules set out by their respective management companies. In our investigation and in speaking to many residents of these apartment buildings, they tell us that many management companies claim some tenants are "grandfathered" in as smokers, while newer tenants are not permitted to smoke. If all of this is true, that then begs the following questions:
1. Why do some of these building have signs posted saying that anyone smoking would be in breach of quiet enjoyment?
2. Why do they provide notices to tenants reminding them of their supposed no-smoking policy?
3. Why do their rental ads on Craigslist state that smoking is not permitted in the building or anywhere on the property?
Given this, we are requesting that property management companies continue to remind tenants of their no-smoking policy, and that all future tenancy agreements include a no-smoking clause that bans the use of tobacco and marijuana in units, balconies, and the entire residential property.
We further request that managers address all complaints of second-hand smoke infiltration in a timely and fair manner, and if they fail to take reasonable and responsible steps in doing so, we will assist tenants in applying for an order requesting the landlords provide all tenants with their right to quiet enjoyment and/or compensate all tenants for the loss of it.
It is also our hope that by creating this petition, more properties will continue to move to a smoke-free policy too.
