Petition for the Restoration of Parental Rights 

The children and both of their parents are in Colombia, a country governed by the rule of law where no individual may act above the law.

The original intention of the trip was a temporary holiday visit for the children and their mother during the school break. There was never consent for a permanent separation. The father did not authorize, consent to, or approve the removal of his children from his care.

For more than seven years, the father has been the children’s primary and daily caregiver. The mother has not been present in the children’s everyday life during this time. There was no court order, no judicial authorization, and no legal process permitting the removal of the children from their father’s care. This situation is unlawful and unacceptable.

Following the holiday trip, the mother failed to return the children and cut off all communication with the father. This action was taken unilaterally, without judicial authorization, and without due process. Such conduct constitutes a violation of fundamental rights protected under the Colombian Constitution.

The Constitution is explicit:

Article 13 – Equality before the law
All persons are equal before the law.
👉 Fathers and mothers have equal rights.

Article 42 – Equality within the family
The family is founded on the equality of rights and duties of both parents.
👉 One parent cannot arbitrarily exclude the other.

Article 44 – Children’s fundamental rights
Children’s rights prevail over all others.
👉 Children have the right to a family and not to be separated from it.

Article 29 – Right to due process
No one may be deprived of their rights without a judicial decision.

Using a temporary holiday as a pretext to permanently separate children from a loving and committed father harms the children and violates the law. Fathers are not optional. Fathers matter.

We demand:

Immediate restoration of contact between the father and his children
Full respect for constitutional due process
Equal parental rights under the law
Protection of the children’s best interests
No parent is above the law.
And no father should lose his children outside the law.

Restore a Father’s Rights

Un padre responsable en Colombia fue separado arbitrariamente de sus dos hijos tras un viaje que debía ser solo de vacaciones, como cada año. No hubo orden judicial ni debido proceso. La Constitución protege a los niños y reconoce que el padre también tiene derechos.

 
Los niños y sus padres están en Colombia, y en Colombia nadie puede hacer sus propias leyes. No a la arbitriaridad de una madre. 

La intención original era un viaje de vacaciones, como se hacía cada año, durante el período de descanso escolar. Nunca hubo consentimiento para una separación permanente, ni autorización judicial para retirar a los niños de la vida de su padre.

Sin embargo, después de ese viaje, la madre no regresó a los niños y cortó todo contacto, sin orden de un juez y sin ningún proceso legal. Esta decisión unilateral vulnera derechos fundamentales protegidos por la Constitución Política de Colombia.

La Constitución es clara:

Artículo 13: Todas las personas son iguales ante la ley.
👉 El padre y el hombre tienen los mismos derechos que la madre.
Artículo 42: La familia se funda en la igualdad de derechos y deberes de la pareja.
👉 Ningún progenitor puede excluir al otro arbitrariamente.
Artículo 44: Los derechos de los niños prevalecen.
👉 Los niños tienen derecho a una familia y a no ser separados de ella.
Artículo 29: Derecho al debido proceso.
👉 Nadie puede ser privado de sus derechos sin decisión judicial.
Separar a los niños de un padre presente y comprometido bajo el pretexto de unas vacaciones y luego impedir su regreso no protege a los niños: los perjudica. Los niños necesitan a su madre y a su padre. El padre no es opcional.

Este padre vive en profunda angustia emocional, privado injustamente de ver, cuidar y acompañar a sus hijos. Sus hijos están perdiendo una relación esencial por una decisión que no está respaldada por la ley.

Exigimos:

Restablecimiento inmediato del contacto entre el padre y sus hijos
Respeto al debido proceso constitucional
Reconocimiento de la igualdad de derechos parentales
Protección real del interés superior de los niños
Ningún padre puede actuar por encima de la ley.
Pero ningún padre puede ser borrado sin ley ni juez.

No a la substración arbitraria de los niños de su entorno familiar con su padre. La madre no debió arbitrariamente Haber hecho esto sin motivo posible. 
Los niños no deben exponerse.
