Abolish Family Court in Favour of Multidisciplinary Allied Health Model

Petition for Abolishing the Old Broken Judicial System in Favour of a New Dynamic Multidisciplinary Model

We, the undersigned, call for the complete abolition of the outdated judicial system, which has consistently prioritised procedural process over meaningful outcomes, and has perpetuated a cycle of coercive violence and abuse. This system—characterised by relentless delays, dismissive attitudes, and a complete failure to recognise the genuine suffering of victims—must be replaced by a holistic, multidisciplinary model based on collaboration among allied health professionals.

Key Points of Our Petition:

Systemic Failure and Coercive Violence:
The current judicial system emphasises rigid processes over the real-world impact on those it purports to protect. This emphasis on procedure creates an environment where coercive violence flourishes, as the system effectively traps victims in a cycle of abuse and trauma.

A Multidisciplinary Alternative:
We propose replacing the existing adversarial model with a non-lawyered, multi-layered allied health professional tribunal panel. This panel, composed of psychologists, social workers, counsellors, and other allied health experts, would utilise trauma-informed, collaborative decision-making processes aimed at genuine healing and rehabilitation rather than punitive measures.

Focus on Tangible Outcomes:
Unlike the current model, which prioritises process at the expense of outcomes, the multidisciplinary approach would ensure that every decision made is directly aligned with the well-being and recovery of victims. This system would focus on restoring lives, safeguarding vulnerable individuals, and ensuring that conflict resolution and social justice is delivered in a manner that truly reflects the needs of those affected.

Universal Protection Against Coercive Violence:
The problem of coercive violence is not confined to any one gender; rather, it is a systemic issue inherent in the way our current judicial system operates. By shifting to a multidisciplinary model, we can address these abuses without resorting to divisive language, instead focusing on universal support and protection for everyone impacted by family violence.

A Call for Immediate Reform:
The ongoing suffering of victims, as exemplified by cases of emotional and financial abuse, must no longer be tolerated. It is our collective responsibility to demand a justice system that is equitable, compassionate, and responsive to the real needs of society—one that puts outcomes before process and restores hope to those who have been systematically failed.

Systemic Tinkering Has Hitherto Failed
Decades of superficial "tinkering" with and within the gravely failing and completely inadequate judicial system have repeatedly stalled any attempts to address its fundamental flaws. Rather than implementing meaningful, systemic change, past 'reforms' have merely skimmed over the deep-rooted issues that continue to allow coercive violence and abuse to flourish. It is now imperative to finally abandon these mediocre half-measures and replace the outdated system with a genuinely intersectional and holistic model—one that comprehensively addresses the complex realities of family dynamics, the multifaceted nature and impact of abuse, and one that delivers real, sustainable outcomes for all victims. This comprehensive approach is the only way to ensure a system that can evolve in a way that is inclusive, compassionate, and responsive to all individuals affected - regardless of gender, race, or background.

We urge policymakers, stakeholders, and the decision-makers to listen to the voices of those who have suffered under the current system. Embrace this transformative approach as a necessary evolution in our family conflict resolution framework—a system that not only upholds social justice but also fosters healing and societal renewal.

The time is long overdue to replace an outdated, broken system with one that prioritises tangible outcomes, genuine support, and the holistic protection of all vulnerable individuals.
