It is time for our nation to take decisive action to protect these innocent lives and adopt a comprehensive, humane approach to shelter management nationwide.

Euthanasia of healthy, adoptable dogs in shelters is an outdated and ethically unacceptable practice. Dogs are literally dumped in wheelbarrows and murdered and then dumped like trash!

While some states and municipalities have taken steps to reduce euthanasia rates, this patchwork approach is insufficient. A unified federal law is necessary to ensure consistent, humane treatment of dogs in every state.

Legislation such as Texas Senate Bill 197 (2019) and California’s “Bowie’s Law” (AB 595) demonstrates that targeted policies can save countless lives. However, these efforts have been limited in scope, leaving millions of shelter dogs vulnerable. The United States must adopt a nationwide no-kill mandate to ensure that every shelter dog is given a fair chance at life, regardless of location.

Proposed National Legislation

To create a compassionate and effective solution, I demand the introduction and passage of federal legislation with the following key provisions:

  1.    Prohibition of Euthanasia for Non-Medical Reasons: Outlaw the euthanasia of healthy or treatable dogs in all shelters nationwide. Exceptions would apply only for dogs with untreatable medical conditions or those posing a clear, unmanageable danger to public safety.

  2.    Mandatory Collaboration with Rescue Organizations: Require shelters to establish partnerships with rescue groups, non-profits, and foster networks to transfer animals before euthanasia is even considered.

  3.    Expanded Funding and Resources: Allocate federal funding to improve shelter infrastructure, provide low-cost spay/neuter programs, and expand access to veterinary care for underserved areas.

  4.    Adoption Incentives and Public Education: Implement tax incentives for adopting dogs from shelters and launch national campaigns to educate the public about adoption and responsible pet ownership.

  5.    Transparency and Accountability: Enforce mandatory public reporting of shelter intake, outcomes, and euthanasia rates to ensure accountability and public awareness.

Background & Problem Statement:

   •   Every year, hundreds of thousands of dogs are euthanized in shelters, many of whom are healthy, adoptable, and simply victims of overcrowding.

   •   Many shelters misclassify dogs as aggressive when they are merely scared, stressed, or suffering from poor living conditions.

   •   During crises such as the 2024–2025 wildfires in Los Angeles, shelters and rescues were able to accommodate a large influx of displaced animals, proving that with the right resources, euthanasia is avoidable.

   •   Some shelters fail to provide clean, safe, and humane environments, leading to neglect, stress-induced behavior, and reduced adoption rates. 

Shelters shall adhere to the following:

*         Adequate space, ventilation, and temperature control.

      •   Access to clean water and nutritious food at all times.

      •   Daily cleaning of kennels to prevent unsanitary conditions.

      •   Regular socialization and exercise opportunities for all dogs.

   •   The current system fails to maximize adoption opportunities, with many dogs not even being seen by the public before euthanasia.

Findings and Purpose

(a) Findings

Congress finds the following:

    1.    Dogs are sentient beings capable of experiencing emotions such as fear, joy, and distress.

 

Key Provisions:

    1.    Euthanasia Prohibition:

      •   Shelters cannot euthanize any healthy or non-aggressive dogs under any circumstances (including overcrowding or time constraints).

      •   Euthanasia is only permissible if:

         •   The dog has a terminal illness or life-threatening injury, as certified by a veterinarian.

         •   The dog exhibits irreversible aggression, as verified by both a licensed animal behaviorist and a veterinarian. Shelters shall implement behavioral rehabilitation programs for dogs exhibiting fear-based behaviors.

*          All healthy and non-aggressive dogs shall be housed indefinitely until adoption, transfer to a no-kill rescue, or suitable long-term placement is found.

   

    2.    Increased Adoption Efforts:

      •   All adoptable dogs must be publicly listed in a national database with photos and descriptions.

      •   Shelters must allow PUBLIC access and outreach efforts to increase adoptions.

      •   Partnerships with rescues and transport programs must be expanded to relocate dogs to no-kill facilities if needed. There are an abundance of volunteer rescue, transport and adoption organizations already doing this for free- to try to save as many lives as possible. But- we need HELP, and we need it NOW!

    4.    Federal Funding & Incentives:

      •   The Humane Shelter Grant Program will provide federal funding to help shelters transition to no-kill policies, expand facilities, and train staff.

      •   Shelters maintaining a 90% or higher live-release rate will receive additional federal funding.

      •   Shelters violating this act will face fines up to $50,000 per violation and potential loss of federal funding.

Benefits of the Bill:

✔ Saves thousands of dogs’ lives by eliminating unnecessary euthanasia.

✔ Improves shelter conditions, ensuring dogs are treated humanely.

✔ Encourages nationwide adoption efforts, reducing overcrowding through responsible placement.
