रायगड जिल्ह्यातील अलिबागमधील शांत किनारी गाव नागाव आज एका निर्णायक वळणावर उभं आहे.

पिढ्यानपिढ्या येथील लोक समुद्रासोबत सुसंवादात राहिले आहेत — घरे बांधत, शेती करत आणि नैसर्गिक सौंदर्यावर आधारित पर्यटन व्यवसाय उभा करत. पण आज हीच समतोल व्यवस्था धोक्यात आली आहे.

Hiranandani Group यांचा Hiranandani Sands नावाचा मोठा प्रकल्प या पर्यावरणीय दृष्ट्या संवेदनशील भागात राबवला जात आहे. विकास आवश्यक असला तरी, हा प्रकल्प ज्या पद्धतीने पुढे नेला जात आहे त्याबाबत स्थानिकांमध्ये गंभीर चिंता व्यक्त होत आहे.

ही केवळ एका प्रकल्पाची गोष्ट नाही.

हा प्रश्न आहे की आपल्या भविष्यावर परिणाम करणाऱ्या निर्णयांमध्ये स्थानिक समुदायाचा आवाज ऐकला जाणार का?

समस्या आणि परिणाम

भराव आणि बांधकामामुळे नैसर्गिक पाण्याचा प्रवाह बदलू शकतो, ज्यामुळे समुद्राचे पाणी गावात शिरण्याची भीती निर्माण झाली आहे. त्यामुळे घरे, शेती आणि उपजीविका धोक्यात येऊ शकतात. अनेक शेतकऱ्यांचे आधीच नुकसान झाले असून उरलेली जमीनही धोक्यात आहे.

तसेच, वनजमिनीच्या वापराबाबत आणि दीर्घकालीन भाडेकरारांबाबत गंभीर प्रश्न उपस्थित होत आहेत, आणि कायदेशीर व पर्यावरणीय प्रक्रिया पूर्णपणे पाळल्या गेल्या आहेत का याबाबत शंका निर्माण होत आहे.

जमिनीच्या व्यवहारांमध्ये पारदर्शकतेचा अभाव असल्याची गंभीर चिंता आहे, तसेच सब-लीज किंवा वापरातील बदल याबाबत पुरेशी माहिती सार्वजनिकपणे उपलब्ध नाही.

सर्वात महत्त्वाचे म्हणजे, नागावकरांना त्यांच्या आयुष्यावर थेट परिणाम करणाऱ्या निर्णयांपासून पूर्णपणे दूर ठेवले गेले आहे. कोणतीही प्रभावी सार्वजनिक चर्चा किंवा सल्लामसलत झालेली नाही.

याचे परिणाम गंभीर आहेत — शेतीचे नुकसान, पर्यटन व्यवसायावर परिणाम, पर्यावरणीय असमतोल आणि संपूर्ण समुदायाचे विस्थापन.

विकास हवा, पण तो लोकांच्या अस्तित्व, पर्यावरण आणि उपजीविकेच्या किंमतीवर नको.

स्थानिकांमध्ये अशीही चिंता व्यक्त होत आहे की, मर्यादित रोजगाराच्या संधी देण्याची घोषणा करण्यात आली असली, तरी त्या रोजगाराचे स्वरूप, दर्जा आणि वाटप याबाबत कोणतीही स्पष्ट माहिती उपलब्ध नाही.

अशी धारणा निर्माण होत आहे की, स्थानिकांना प्रामुख्याने कमी पगाराच्या, सहाय्यक स्तरावरील नोकऱ्यांपुरतेच मर्यादित ठेवले जाईल, तर कौशल्याधारित, प्रशासकीय किंवा निर्णयक्षम पदांमध्ये त्यांचा सहभाग नगण्य राहील. तसेच, प्रकल्पामधील व्यावसायिक जागा, टेंडर किंवा व्यवसाय संधींमध्ये स्थानिकांना प्राधान्य दिले जाणार का, याबाबतही कोणतीही पारदर्शक माहिती उपलब्ध नाही.

अशा प्रकारचा विकास स्थानिकांना त्यांच्या स्वतःच्या जमिनीवर फक्त प्रेक्षक बनवण्याचा धोका निर्माण करतो.

• वनजमिनीच्या वापराबाबत Forest Conservation Act, 1980 अंतर्गत आवश्यक परवानग्या आणि अटींचे पालन झाले आहे का, हा प्रश्न आहे.
• अशा प्रकल्पांसाठी Environmental Impact Assessment (EIA) Notification, 2006 अंतर्गत सार्वजनिक सुनावणी आणि पर्यावरणीय परिणामांचे प्रकटीकरण आवश्यक असते. मात्र, अशा पारदर्शक प्रक्रियेचा अभाव दिसून येतो.
• भरावामुळे नैसर्गिक जलप्रवाहात बदल होऊन भारतीय संविधानाच्या कलम 21 अंतर्गत जीवन आणि उपजीविकेच्या हक्कावर परिणाम होऊ शकतो.
• जमिनीच्या व्यवहारांमध्ये काही अनियमितता आढळल्यास, त्याची तात्काळ चौकशी आवश्यक आहे.
• अशा प्रकल्पांमध्ये समावेशक आणि न्याय्य विकासाची तत्त्वे पाळली जाणे अत्यावश्यक आहे, ज्यामध्ये स्थानिकांना केवळ प्राथमिक स्तरावरील रोजगार नव्हे, तर कौशल्याधारित, निर्णयक्षम पदे आणि व्यावसायिक संधींमध्येही समान संधी मिळाल्या पाहिजेत.

• बाधित जमीन आणि पर्यावरण पुनर्संचयित करावे
• स्थानिकांसाठी रोजगार आणि आर्थिक सहभागाबाबत पारदर्शक आणि सार्वजनिक धोरण जाहीर करावे, ज्यामध्ये कौशल्याधारित नोकऱ्या, व्यवस्थापकीय पदे तसेच टेंडर, भाडेपट्टी आणि व्यावसायिक संधींमध्ये स्थानिकांना प्राधान्य दिले जावे, मात्र पर्यावरणीय व कायदेशीर नियमांचे पालन अबाधित ठेवून

Introduction

Nagaon, a peaceful coastal village in Alibaug, Raigad, is today standing at a critical crossroads.

For generations, its people have lived in harmony with the sea — building homes, agriculture, and a thriving tourism economy around its natural beauty. But today, that very balance is under threat.

A large-scale development project by Hiranandani Group, known as Hiranandani Sands, is being carried out in and around this ecologically sensitive region. While development is important, the manner in which this project is progressing has raised serious concerns among local residents.

This is not just about one project.

It is about whether local communities have a voice in decisions that shape their future.

Problem & Impact

There is a growing fear that land filling and construction activity may alter natural water flows, leading to seawater entering the village — putting homes, farms, and livelihoods at risk. Many farmers have already suffered losses, and the remaining land now faces uncertainty.

Equally alarming are concerns around the use and long-term leasing of forest land, and whether due legal and environmental procedures have been fully followed. Locals are questioning how land that was once accessed and used by the community is now seemingly beyond their reach.

There are also serious concerns about transparency — whether land transfers and agreements have occurred in accordance with the law, and whether any form of sub-leasing or change in land use has taken place without adequate public knowledge.

Most importantly, the people of Nagaon feel excluded from decisions that directly affect their lives. There has been little to no meaningful public consultation, leaving the community unheard in the face of irreversible change.

The consequences are severe — loss of agricultural land, damage to tourism livelihoods, ecological imbalance, and the gradual displacement of an entire community.

Development cannot come at the cost of displacement, environmental damage, and loss of livelihood.

Local residents are also concerned that while employment for a limited number of people has reportedly been indicated, there is no clarity on the nature, quality, and distribution of these opportunities.

There is a growing perception that such employment may be largely restricted to low-wage, support-level roles, with little to no access for locals to skilled, managerial, or decision-making positions. Additionally, there is no publicly available framework on whether local entrepreneurs will be given fair access to commercial spaces, tenders, or business opportunities within the project.

Development that does not ensure meaningful and upward economic participation risks reducing local communities to mere spectators in projects built on their own land.

Authorities Addressed

This petition is addressed to the following authorities responsible for safeguarding environmental integrity, legal compliance, and citizens’ rights:

• The District Collector, Raigad
• The Maharashtra Forest Department
• The Maharashtra Coastal Zone Management Authority (MCZMA)
• The Ministry of Environment, Forest and Climate Change (MoEFCC), Government of India
• The Gram Panchayat of Nagaon, Alibaug
  We urge these authorities to take immediate cognizance of the concerns raised by local residents.

Legal & Environmental Concerns

The concerns raised by the residents of Nagaon are not merely emotional—they are grounded in serious legal and environmental implications that require urgent scrutiny.

• The project appears to be situated within a coastal and ecologically sensitive zone, potentially attracting regulations under the Coastal Regulation Zone Notification, which strictly governs construction, land filling, and alteration of natural coastal features.
• The reported use and long-term leasing of forest land raises questions under the Forest Conservation Act, 1980, which mandates prior approval and strict conditions before forest land can be diverted for non-forest purposes.
• Additionally, large-scale development projects of this nature typically require compliance with the Environmental Impact Assessment (EIA) Notification, 2006, including public consultation and disclosure of environmental consequences. The apparent lack of adequate and transparent public hearings raises concerns about procedural compliance.
• The potential alteration of natural drainage patterns due to land filling may directly threaten the Right to Life and Livelihood under Article 21 of the Constitution of India, as recognized in multiple judicial precedents.
• Any irregularity in land transfer, leasing, or sub-leasing arrangements, if established, may constitute a violation of statutory provisions and require immediate legal review.
• Any development of this scale must adhere to principles of equitable and inclusive growth, ensuring that affected communities have fair access not only to basic employment, but also to skilled roles, economic opportunities, and local enterprise participation, in line with constitutional protections of livelihood and dignity.

In light of the above, it is imperative that all approvals, processes, and environmental safeguards related to this project be independently examined before any further irreversible action is taken.

• Immediate suspension of the project until full review
• Independent environmental and hydrological impact assessment
• Disclosure of all approvals, leases, and land transfer documents
• Cancellation of any illegal or non-compliant lease agreements
• Mandatory public hearing with participation of local residents
• Restoration of any damaged forest and coastal land
• Ensure a transparent, fair, and publicly disclosed framework for local employment and economic participation, including access to skilled and supervisory roles, as well as opportunities for local businesses through tenders, leases, and commercial allocations, without compromising environmental and legal safeguards
