Музиканти оркестру НГУ в полоні! Репатріація у нейтральні країни світу військовополонених.

Я, Ємельяненко Анастасія Андріївна, дружина артиста оркестру 12 бригади, військової частини 3057 Національної гвардії України. Ця петиція створена за ініціативи сімей військових музикантів, які потрапили до полону Російської Федерації з заводу «Азовсталь» у м. Маріуполь. 

Українські військові, яких було повернено з полону Російської Федерації, неодноразово наголошували в ЗМІ на фізичних і моральних знущаннях, які російська сторона застосовує до українських військовополонених в місцях їх утримання. Родини військовополонених не мають зв’язку з ними. На сьогодні російська сторона не підтвердила місце перебування в полоні більшості українських військових. Більш того, Російська Федерація не дає можливості виконувати свої зобов’язання представникам Міжнародного Червоного Хреста щодо контролю умов перебування українських військових та ставить під сумнів збереження життя і здоров’я полонених, які утримуються російською стороною.

29.07.2022 на невизнаній території Донецької Народної Республіки (ДНР) в колонії населеного пункту Оленівка, російською стороною було здійснено теракт над українськими військовополоненими. В наслідок обстрілу приміщення, частина українських військових загинули або отримали поранення.  Цей терористичний акт є доказом того, що Російська Федерація намагається приховати від світової спільноти свої злочини, вбиваючи полонених з особливою жорстокістю.

Представники Міжнародного Червоного Хреста наголошували, що всі військовополонені перебувають під захистом міжнародного гуманітарного права, незалежно від їх місця утримання. У травні 2022 року Міжнародний Червоний Хрест взяв на себе зобов’язання гаранта безпеки українських військовополонених. Однак станом на зараз, за безпеку полонених повністю відповідає країна, що взяла їх в полон. Дивлячись на події в населеному пункті Оленівка, Росія не може надати безпечне перебування українських полонених та ставить під загрозу їхнє життя та здоров’я. В такому випадку доцільним рішенням є - евакуювати українських військовополонених, що утримуються російською стороною, до третьої країни. 

Шановний Президент Туреччини, Редже́п Таї́п Ердога́н, враховуючи вищевказане, Я, Ємельяненко Анастасія Андріївна, від імені всіх родин військовослужбовців 12 бригади, військової частини 3057 Національної гвардії України, які перебувають в полоні, звертаюсь до Вас з проханням застосувати процедуру інтернування, евакуації українських військовополонених 12 бригади у будь-яку нейтральну країну світу.

Враховуючи Розділ IV статтю № 109 Женевської конвенції «Безпосередня Репатріація та Госпіталізація у Нейтральні країни», який наголошує:

“Упродовж бойових   дій   сторони   конфлікту  намагаються  за  сприяння   зацікавлений   нейтральних    держав    організувати  госпіталізацію   в   нейтральних   країнах   хворих  та  поранених  військовополонених,  про яких ідеться в другому  абзаці  вказаної  статті. Вони можуть, крім того, укладати угоди з метою репатріації або інтернування в нейтральній країні здорових військовополонених, які вже тривалий час перебувають у полоні.”

Акцентуємо на тому, що Російська Федерація не дотримується ведення законів війни, розділів Женевської конвенції «Про поводження з військовополоненими», а саме: 

-         не допускають представників Міжнародного Червоного Хреста;

-         полоненні піддаються катуванням;

-         не мають належного харчування;

-         утримуються в жахливих умовах без можливості елементарної гігієни;

-         поранені не мають відповідної медичної допомоги.

-         використовується моральний тиск ти дезінформація стосовно подій на фронті, життя та безпеки родини.

Ми закликаємо Президента Туреччини, світову спільноту та ООН підтримати нас та проявити наполегливість у захисті військовополонених шляхом проведення процедури інтернування та вивезти до нейтральних країн усіх полонених 12 бригади військової частини 3057 НГУ, зокрема артистів оркестру, які вже багато місяців утримуються Російською Федерацію, і яким країна агресор не гарантує збереження здоров'я і життя.

Кожен з них мріє повернутись до рідної України та мати можливість підіймати дух українців і підсилювати віру в перемогу! 

Musicians of the National Guard Orchestra  are the POWs! Repatriation and accommodation in neutral countries required!

I am, Yemelyanenko Anastasia Andriivna, a wife of an artist of the orchestra of the 12th brigade, military unit 3057 of the National Guard of Ukraine. This petition was created on the initiative of the families of military musicians who were captured by the Russian Federation from the Azovstal plant in Mariupol.

Ukrainian soldiers who were returned from captivity in the Russian Federation have repeatedly emphasized in the mass media the physical and moral abuse that the Russian side applies to Ukrainian prisoners of war in places of their detention. The families of the prisoners of war do not have the opportunity to contact them and the Russian side has not confirmed the whereabouts of the majority of Ukrainian soldiers in captivity yet. Moreover, the Russian Federation does not give the representatives of the International Red Cross the opportunity to fulfill their obligations regarding the control of the conditions of stay of the Ukrainian military, and calls into question the preservation of the lives and health of prisoners held by the Russian side.

On July 29, 2022, the Russian side carried out a terrorist attack against Ukrainian prisoners of war on the unrecognized territory of the Donetsk People's Republic (DPR) in the colony of Olenivka settlement. As a result of the shelling by the Russian side of the premises where the Ukrainian prisoners were located Ukrainian military personnel were killed and wounded. This terrorist act proves the fact that the Russian Federation is trying to hide its crimes from the world community killing the prisoners with particular cruelty.

Representatives of the International Red Cross emphasized that all prisoners of war are protected by international humanitarian law regardless of their place of detention. In May 2022, the International Red Cross assumed the responsibility of guaranteeing the safety of Ukrainian prisoners of war. The captive country is fully responsible for the safety of prisoners. Russia can not provide a safe stay for Ukrainian prisoners and endangers their lives and health on the basis of the events that happened in the settlement of Olenivka. In such a case it is expedient to evacuate Ukrainian servicemen held by the Russian side to a third world country.

Dear President of Turkey, Recep Tayyip Erdoğan, taking into account the above mentioned facts I, Anastasiya Andriivna Yemelyanenko, on behalf of all the families of servicemen of the 12th brigade, military unit 3057 of the National Guard of Ukraine who are in captivity, appeal to you to apply the procedure of internment, evacuation to any neutral country world of Ukrainian prisoners of war of the 12th brigade.

Considering Chapter IV Article No. 109 of the Geneva Convention "Direct Repatriation and Hospitalization in Neutral Countries" which emphasizes:

"During hostilities the parties of the conflict with the assistance of interested neutral states are trying to organize hospitalization in neutral countries of sick and wounded prisoners of war which are referred to in the second paragraph of the specified article. They may, in addition, enter into agreements for the repatriation or internment in a neutral country of healthy prisoners of war who have been in captivity for a long time."

We emphasize that the Russian Federation does not observe the laws of war, the sections of the Geneva Convention "On the Treatment of Prisoners of War", namely:

representatives of the International Red Cross are not allowed to visit the places where the prisoners are held;
the prisoners are subjected to torture;
they don’t have proper nutrition;
they are kept in terrible conditions without the possibility of elementary hygiene;
the wounded do not have appropriate medical care;
the prisoners are subjected to moral pressure and disinformation are used regarding the events at the front, the life and safety of the family.
We appeal to the President of Turkey, the world community and the UN to support us and show perseverance in the protection of the prisoners of the war, so that through the internment procedure all prisoners of the 12th brigade of the military unit 3057 NSU, including the musicians of the orchestra who have been held by the Russian Federation for many months and who the aggressor country does not guarantee the preservation of health and life.

Each of them dreams of returning to their native Ukraine and having the opportunity to raise the spirit of Ukrainians and strengthen their faith in victory!
