Fix Australia's Drug Driving Legislation

Currently, medicinal cannabis is readily available to ANY Australian who can afford the prescription and associated fees, regardless of the presence of a terminal illness.

In the ACT, a person may cultivate 2 cannabis plants by natural means, without a prescription, with a limit of 4 plants per household and limits on the weight of finished product that can be retained from the plants.

Cannabis is the only prescribed medication with this kind of associated legislation. With the rapidly growing number of people experiencing the benefits of cannabis, patients are calling for drug-driving legislation to be brought up to speed with medical developments.

A landmark study conducted by Scientists from the Lambert Initiative on how cannabis affects driving ability has shown that cannabidiol (CBD), a cannabis component now widely used for medical purposes, does not impair driving, while moderate amounts of the main intoxicating component tetrahydrocannabinol (THC) produce mild driving impairment lasting less than four hours.

David Heilpern, a former NSW Court Magistrate resigned in 2020 citing drug driving laws are so ‘grossly unfair’ he can’t apply them.

Fiona Patten, a member of the Victorian Legislative Council is gaining traction with past Road Safety Amendment (Medicinal Cannabis) Bill 2019. The effect of this Bill is simple – to treat these medicines, prescribed by a doctor, in the same way as any other prescription medication under the Road Safety Act.

The Bill strikes the same balance that already exists for the many other prescription medications capable of intoxicating effects (opioid analgesics, benzodiazepines, antihistamines, etc.) all of which do not hinder your right to operate a vehicle.

Legislation to allow people to drive with medicinal cannabis in their system is also set to go before the South Australian parliament thanks to Greens upper house MP Tammy Franks.

With confusing and contradicting state by state laws we need federal action immediately!
