Justice for our Voiceless Soul

An elephant that was pregnant died in Kerala, standing in water, after she faced one of the most brutal forms of animal abuse. She ate a pineapple filled with firecracker, offered to her allegedly by some locals. The fruit exploded in her mouth, leading to the inevitable tragedy. Perhaps a more important question to ask is why we hear so much about voiceless deaths, and not enough about prosecutions? Due to loopholes in the judicial system how many will actually end up being sentenced? The disparity between sentencing in our country is great. The law in India does not assign long prison sentences to wildlife crime. There should be a strong fear amongst that would-be killers of the innocent who must know that they might not go home alive, and would be shot even if they surrendered Conviction of wildlife killing must receive a rigorous sentencing with hefty fines. And until India's wildlife laws were updated recently, penalties for killing were simply fines that had not risen in to keep pace with the atrocities caused to our beloved animals. Even where tough laws do exist, for a criminal case, it can be difficult to prove beyond all reasonable doubt that a killer is guilty. Too often, the expertise or evidence is not available for any type of sophisticated analysis. Even if, the convict is caught, many of them would be awaiting trial dates, and appeals which could be sent out for more evidence from the public to complete these prosecutions. There is general frustration about the prosecution of the animal killers. It is important to build the political will to ensure that prison sentences are given. Time and time again, killers are awarded bail and abscond, or are acquitted at trial. If this is the case, then legal measures to crack down on killing are not working. Shoot-to-kill may not be a one-size-fits-all solution for the killers of innocent animal, it must be exercised in this rare case of killing of a mother and an unborn child. We must continue to challenge the so called law to stop this type of inhuman act. We stand the best chance possible of turning back the tide on killers with harsher punishments. Often the punishment is not in proportion to the crime. It is up to us to lend our own voices to the voiceless. Hopefully, the inhuman and atrocious killer will be convicted and punished for harming an innocent animal.

SAVE KERALA FROM MULLAPPERIYAR DAM DISASTER

Honb'le Prime Minister of India, Greetings to you. May grace and peace be yours in abundance through knowledge of the Omnipotent. I pray for your good health and happy long life. I write this petition with great anguish,utmost disappointment and agony. I am  residing with my family consisting of my wife and children along with 4 millions of people and a million of migrated laborers from  all over India beneath a more than century old dam consisting of 15 TMC water spreading over 4668 Acres of land- The Mullaperiyar Dam! A  case of constant tussle and litigation is ongoing for many years between the Governments of Kerala and Tamil Nadu causing regular tension between the people in a Federal structure of national entity. Politicians of the two provinces are playing over the petty sentiments of the people for gaining electoral advantages.The 152 feet reservoir of the dam is thus a Political matter for the concerned, but the facts are beyond the scope of petty Politics of Provincialism. This is a case of ecological, economical, human disaster. Not only human, the entire flora and fauna is to perish in the part of the World if the dam is to continue without any move to rectify the risks involved. Due to the disaster waiting in the wings more than a lakh of people between the dam and the Idukki reservoir 40km below the dam, more than 40 lakhs of people in the lower reaches  of Periyar, Azhutha, Meenachilar, Pamba and Manimalayar rivers spreading over 5 districts will be drowned causing not only loss of millions of lives of human and animal population but also precious housing properties and agriculture fields placing a total loss amounting to billions and billions of rupees. As everybody know, this dam has been constructed on an unusual agreement of 999 years(10 centuries). This contract was made in between the Secretary of State under British and the King, His Highness the Visakham Thirunal Marthandavarma,the then King of Travancore, the vassal state under the British. All agreements made by the British are either nullified or cancelled immediately after Independence. Unfortunately, the slavery of people of Kerala in this regard is continuing even after the Independence. The dam is more than a century old and sick. No dam in the world is old as this dam. Other dams constructed contemporary to the Mullaperiyar Dam is either demolished or decommissioned. This dam was constructed using Lime Surky concrete which is 6 times inferior than the present M30 concrete used for construction. Already a good portion of lime has been washed away. There is leakage at the surface and gallery of the Dam. A leakage is found in between the 17th and 18th block. The Legislative Sub Committee has examined the dam and found that there is leakage between 10th and 11th block of the dam. The quantity of the seepage water is increasing day by day. A severe damage was found in the masonry structure at 95 to 106 door from the base of the dam. Apart from innumerable patholes, crevices and other openings that are visible on the surface of the Dam, the masonry cover provided at the upstream portion of the Dam has undergone a crushing between 95 to 106 foot through the entire length of the Dam.The damage that the dam has undergone in between the above noted elevation is so severe that no rectification can save the Dam from a disaster.More importantly no technology has developed in the whole world to perfectly strengthen a dam which is old and deteriorating. Therefore the strengthening works done has actually weakened the dam. Considering all these, the report relied by the Hon'ble Supreme Court of India in the Mullaperiyar Dam case is misguiding, unscientific and baseless. It is most pertinent to note that the Hon'ble Supreme Court of India has appreciated the apprehensions of the people through an order in the writ petition filed by the Adv. Russel Joy in which the Prime Minister of India is the first Respondent. It is significant to note the dangerous situation going to be faced by the people in 5 districts of Tamil Nadu. If the dam bursts, the fate of these people would be severe that no could imagine. After the collapse, construction of a new dam is not at all possible under the present laws.The laws are changed and it became so progressive than the laws prevailed at the time of construction of the Mullaperiyar Dam. So the situation of the people of Tamil Nadu will be more worse than the situation prior to the construction of the Dam. Under the aforementioned facts and keeping in mind the well being of the people of Kerala and Tamil Nadu, I humbly appeal appeal to the Hon'ble Prime Minister to urgently interfere in this matter to rectify the evil of the British immediately by an order in consensus with the State of Kerala and the State of Tamil Nadu for the construction of a new dam which will bring back the safety of people of Kerala and water to our neighboring State.

Justice for the Pregnant Elephant Brutally Killed in Kerala

To whom it may concern, A pregnant elephant died in Kerala last Wednesday, after she faced one of the most brutal forms of animal abuse. She ate a pineapple filled with firecrackers, offered to her allegedly by some locals. The fruit exploded in her mouth, badly injuring her tongue and mouth. The elephant walked around in the village, in searing pain and in hunger. She was unable to eat anything because of her injuries.       The elephant remained calm, though she was under excruciating pain she didn’t attack any one as she ran in the streets of the village. She didn't crush a single home or created any havoc. The 15-year-old elephant just stood in the river so that her mouth and tongue which had exploded could get some form of relief. Unfortunately she died standing in the river. The incident was brought to light by Mohan Krishnan, Section Forest Officer, Nilambur, on his Facebook page This is really disheartening and makes us sick to the core. There have been several animal abuse incidents in India in last few months and unless a strict action is taken against the offenders these abuses and assaults on animals will never stop. We personally feel that a charge of murder should be slapped against the people involved in this brutal murder. We would therefore request the government of India to take an immediate action against the offenders. Sign and share my petition so we can get justice for the elephant.

ENUn elefantessa incinta è morta nel Kerala, regione dell'India, lo scorso mercoledì, dopo aver affrontato una delle forme più brutali di abuso su animali. E' morta dopo aver mangiato un ananas pieno di petardi, che le era stato offerto presumibilmente da alcuni locali. Il frutto le è esploso in bocca, ferendola gravemente.Il povero animale ha girovagato nel villaggio, con dolore lancinante e affamata, ma non è riuscita a mangiare nulla a causa delle ferite. E' rimasta calma, nonostante la sofferenza e il dolore lancinante.Non ha attaccato nessuno mentre correva per le strade del villaggio, non ha distrutto una sola casa, né creato alcun caos.L'elefantessa si è diretta al fiume, in modo che la sua bocca e la lingua potessero avere sollievo dalle fiamme. Purtroppo, però, è morta nel fiume. Sull'episodio ha fatto luce Mohan Krishnan, responsabile forestale, Nilambur, sulla sua pagina Facebook, con questo messaggio: "Questo è davvero scoraggiante e ci fa stare male in modo incredibile. Ci sono stati diversi episodi di abuso di animali in India negli ultimi mesi e, a meno che non venga intrapresa un'azione rigorosa contro i trasgressori, questi abusi e aggressioni sugli animali non si fermeranno mai."Riteniamo personalmente che l'accusa di omicidio debba essere avanzata contro le persone coinvolte in questo brutale omicidio. Vorremmo pertanto chiedere al Governo Indiano di agire immediatamente contro i trasgressori. Firma e condividi la mia petizione in modo che possiamo ottenere giustizia per l'elefantessa.

#NoOnlineExamNoVote We had Online classes, so we want Online exams (KTU 2021 Odd Sem)

Even though the covid condition has been more stable, it has not been fully eradicated from Kerala. Kerala Technological University(KTU) was of the view that 'Online classes were not sufficient for proper education', but now they are conducting offline semester examinations with even less study time than usual. Most colleges haven't finished teaching the full syllabus and many lack proper study materials. For a university with an average pass percentage of 30%, online teaching isn't enough to prepare us for the offline exams. Kerala Technological University(KTU) had already conducted online exams for final semesters last year, which proves that it is possible to conduct online exams as a substitute in the current situation. IIT's, NIT's and many other engineering colleges have already conducted online exams, so why not KTU. They teach us in online mode but want to examine us in offline mode, which is hypocritical, unfair, dangerous, and doesn't reflect the best interests of the students. So we request the examination to be conducted online rather than offline. So we humbly request everyone to sign so the proper authorities can have a clear view about the current academic situation and perspective of the students. Edit : #NoOnlineExamNoVote  #KeralaElections Guys we have been marginally successful with the final years, but nothing has been done for our intermediate semester students, that is, S3 and S5 students, who are waiting for a miracle to get them to pass this exam. Just before a week from the start of  the final years exams, KTU adjusted the timetable to give them more time to learn, which means it isn't too late for S3 and S5. So make noise and spread #NoOnlineExamNoVote and don't forget, elections are coming and all of us have votes!

Justicia para la elefanta embarazada brutalmente asesinada en Kerala, India

Una elefanta embarazada murió en Kerala, India el pasado miércoles víctima de un acto brutal de maltrato animal. Algunos lugareños le dieron una piña llena de petardos supuestamente. La fruta explotó en su boca, hiriendo gravemente su lengua y su boca. Esta elefanta caminó hasta el pueblo con un dolor punzante y hambre, no pudo comer nada debido a sus heridas. Permaneció calmada a pesar de tener un dolor insoportable, no atacó a nadie mientras corría por las calles de la aldea. No aplastó ninguna casa ni creó caos. La elefanta de 15 años simplemente se paró en el río para que su boca y su lengua heridas por la explosión pudieran obtener algún tipo de alivio. Desafortunadamente, murió de pie en el río. El incidente fue revelado por Mohan Krishnan, Oficial de la Sección Forestal, Nilambur, en su página de facebook. Esto es realmente horroroso y nos enferma hasta la médula. Ha habido varios incidentes de maltrato animal en India en los últimos meses y, a menos que se tome una acción estricta contra los delincuentes, estos abusos y agresiones contra animales nunca acabarán. Personalmente, creemos que se debe imponer un cargo de asesinato contra las personas involucradas en este brutal asesinato. Vahşice Öldürülen Hamile Fil için Adalet

English Geçtiğimiz Çarşamba günü, Hamile bir fil, hayvan istismarının en acı biçimlerinden birine maruz kalarak öldürüldü. Olay Hindistan’ın Kerala eyaletinde gerçekleşti. Ölüm nedeni, yerel halktan birilerinin kendisine, içinde patlayıcı saklı olan bir ananas yedirmesiydi. Ananas, filin ağzında patladı, dilini ve ağzını kötü bir şekilde yaraladı. Fil acı çekerek ve aç bir şekilde bir süre köyde dolaştı. Yaraları nedeniyle hiçbir şey yiyemedi. Yaşadığı dayanılmaz acıya rağmen fil sakindi, köyün sokaklarında dolaşırken  kimseye saldırmadı. Tek bir evi ezmedi ve kimseye zarar vermedi. 15 yaşındaki fil, nehirde öylece durdu, yaralanan ağzını ve dilini bu şekilde rahatlamaya çalıştı. Sonunda daha fazla dayanamadı ve nehirde durduğu yerde öldü. Olay, Nilambur Orman Yetkilisi Mohan Krishnan’ın Facebook sayfasında duyurmasıyla gün ışığına çıktı.   Bu korkunç olayı düşündükçe kahroluyoruz. Hindistan'da son birkaç ay içinde birden fazla hayvan istismarı olaylı yaşandı. Suçlulara katı yaptırımlar gelmediği sürece, hayvanlara yönelik bu istismar ve saldırılar asla durmayacaktır. Bu vahşi cinayete karışanların cinayet suçundan yargılanmasını istiyoruz.  Bu nedenle Hindistan hükümetinden derhal harekete geçmesini talep ediyoruz. Petition to the Prime minister of India to save 35,00000 Indians from possible dam break

Mullaiperiyar Dam is a masonry gravity dam on the Periyar River in the Indian state of Kerala. It is located 881 m (2,890 ft) above mean sea level, on the Cardamom Hills of the Western Ghats in Thekkady, Idukki District of Kerala, South India. It was constructed between 1887 and 1895 by John Persnickety and also reached in an agreement to divert water eastwards to the Madras Presidency area (present-day Tamil Nadu). It has a height of 53.6 m (176 ft) from the foundation, and a length of 365.7 m (1,200 ft). The dam was constructed using stone rubble masonry with lime mortar grouting following prevailing 19th-century construction techniques that have now become archaic, seepage and leaks from the dam have caused concern. Moreover, the dam is situated in a seismically active zone. An earthquake measuring 4.5 on the Richter scale occurred on 7 June 1988 with maximum damage in Nedumkandam and Kallar (within 20 km of the dam). Subsequently, several tremors have occurred in the area in recent times. These could be reservoir-induced seismicity, requiring further studies according to experts. A 2009 report by IIT Roorkee stated that the dam "was likely to face damage if an earthquake of the magnitude of 6.5 on the Richter scale struck its vicinity when the water level is at 136 feet". There are serious violations on the safety aspects of the dam in terms of seismological safety,hydrological safety and environmental safety. The dam has been under-designed because at the time of its construction cement was not available and hence neither a masonry dam in cement mortar nor a concrete dam with cement mortar could be built to ensure better safety standards. The old methods of constructionfollowed about a century ago enabled the engineers to use only surkhi mortor with lime, sandand rubble stone was used for the construction of the dam. Since the dam was under-designedand with poor materials of construction it is bound to collapse due to aging also. Moreover themagnitude of peak floods to be used for the spillway design was based upon rough estimateswhich do not confirm to the modern estimates of extreme floods as recommended by experts ofthe International committee on large dams Even the seismic potential was under- estimatedHence there are abundant chances for the dam to collapse and such an accident will result inthe death of about 36,00000 people living downstream and the wiping off of many towns and cities which include Kochi city as well.  Consequently the people of Kerala living downstream of the dam are vociferously demanding for the implementation of dam review policies followed for evaluation of safety of the existing dams and take remedial actions to protect the lives of the people and their properties. But there is no unanimousagreement on this subject of dam safety between Kerala, Tamil Nadu and the Union Governmentand this as resulted in a controversy on the safety of the dam. People of  Kerala is demanding for the removal of the existing aged and decaying damon the plea that its inevitable collapse within the near future will result in an avoidable manmade disaster like the Bhopal tragedy in India and the Fukushima nuclear accident in Japan. Due to this disaster waiting in the wings,  more than a lakh of people between the dam and theIddukki reservoir 40km below the dam more than 35 lakhs of people in the lower reaches ofPeriyar river upto Ernakulam-Cochin belt will be drowned causing not only loss of millions oflives and property.   We request the Prime Minister of India, Sri Narendra Modi to intervene in this matter as fast as possible and save our lives. We believe that you have the capability to do this for us.  I am drafting this petition from the middle of the Kerala floods 2019, and we cannot even think of a possible dam-break. प्रिय नागरिकों, हमारे राज्य केरल में एक गर्भवती हथिनी की दुखद मृत्यु से मैं काफ़ी दुखी हूँ। इस दुर्भाग्यपूर्ण घटना ने हर किसी को गहरा दुख दिया है और लोग नाराज़ हैं। इस नाराज़गी के कारण इस मुद्दे पर हज़ारों पेटीशन देखने को मिलीं। जनता का गुस्सा जायज़ है और इसे हर कोई समझता है। मैं आप सभी को भरोसा दिलाना चाहता हूं कि ये मुद्दा हमारी प्राथमिकता है। केरल के वन विभाग ने इसका संज्ञान लेकर वन्य जीव (संरक्षण) अधिनियम, 1972 के तहत मामला दर्ज किया है। साथ ही केरल पुलिस ने विस्फोटक अिधिनयम, 1884 एवं पशुओं के प्रति क्रूरता रोकथाम अधिनियम 1960 के तहत भी केस दर्ज किया है। इन विभागों की दो उच्च स्तरीय टीम इस घटना की जांच कर रही हैं। मैंने पहले ही राज्य सरकार के समक्ष ये मुद्दा उठाया है और इस दुखद घटना पर उनसे अपनी पीड़ा ज़ाहिर की है। केरल सरकार इस मामले में पर्याप्त और कड़े कदम उठा रही है। दोषियों को कानून का सामना करना होगा, वो बख्शे नहीं जाएंगे। धन्यवाद, आरिफ़ मोहम्मद खान राज्यपाल, केरल

Two High-Level Special Teams of these departments are investigating the cases. I have already taken up the matter with the State Government, expressing my anguish about this incident.
