We, the undersigned, come together today to demand justice for Jennifer Waters, a woman wrongfully convicted and sentenced to 15 years in prison for crimes she did not commit. Her case is a poignant illustration of the deep flaws and injustices within our criminal justice system, and it compels us to call for urgent reform to prevent such miscarriages of justice from happening to others.

On September 23, 2024, Jennifer was sentenced based on the testimony of Danny Fugate, her co-defendant, who is a self-admitted criminal with a history of manipulating the system for his own gain. Just two days before Jennifer's trial, Danny accepted a proffer agreement from the state, promising him a minimal sentence in exchange for his testimony against her. This agreement allowed him to escape a potential 15+ year sentence, resulting in only 6 months in county jail and 4 years of probation. In stark contrast, Jennifer, a devoted mother striving to rebuild her life after the tragic loss of her children's father, was unjustly condemned.

Danny’s testimony raises serious concerns regarding its credibility. He not only has a history of dishonesty but also admitted to suffering from Alzheimer's disease, casting further doubt on his ability to provide reliable testimony. How can we trust the word of a man with significant memory issues, especially when motivated by jealousy and a desire to deflect blame? The prosecution's reliance on such testimony highlights a troubling trend within our justice system—a tendency to prioritize convictions over truth.

The coercive tactics employed by the prosecution in this case are emblematic of a larger issue that undermines the very foundation of our justice system. Allowing co-defendants to testify only after receiving promises of lesser sentences should be outlawed. This practice leads to:

1. Incentivizing Lies: When individuals know they can reduce their sentences by providing damaging testimony against another, it creates a powerful incentive to fabricate or exaggerate accusations, undermining the reliability of the judicial process.

2. Erosion of Trust: This practice breeds distrust in the system. If the public believes that testimonies are bought and sold, they will lose faith in the very institutions designed to protect them.

3. Injustice for the Innocent: Innocent individuals, like Jennifer, are left vulnerable to wrongful convictions based on unreliable testimonies from those seeking to save themselves. This not only ruins lives but also perpetuates a cycle of injustice that disproportionately affects marginalized communities.

For four long years, Jennifer was pressured to testify against Danny, coerced into providing false statements that aligned with the prosecution’s narrative. They assumed, due to her past relationship with him, that she must possess knowledge of his guilt. However, Jennifer stood firm in her integrity, refusing to fabricate lies about a man she did not truly understand.

Jennifer is not just a victim; she is a loving mother who recently remarried, finding hope and solace in a new life with her husband and children. They had begun to heal together after the heartbreaking loss of the children’s father, with whom she had amicably co-parented. It was during this fragile period of rebuilding that she was unjustly torn from her family, leaving behind her children now without both parents and a community that relied on her strength and love.

The inherent flaws of our justice system are starkly evident in Jennifer’s case. According to the National Registry of Exonerations, innocent people are wrongfully convicted almost daily. In 2019 alone, there were 143 exonerations—143 innocent lives disrupted and devastated by a system that too often prioritizes expedience over justice.

Eyewitness error is the single greatest cause of wrongful convictions nationwide, implicated in 72% of cases overturned through DNA testing. Additionally, perjury plays a significant role in these injustices. In 18% of wrongful conviction cases overturned through DNA testing, informants provided false testimony that was crucial to the conviction of the defendant in the original trial. Often, statements from individuals with  incentives to testify—incentives that are not disclosed to the jury—serve as primary evidence that can lead to the conviction of an innocent person.

Compounding these issues is the reality of official misconduct. While some wrongful convictions result from honest mistakes, far too many arise from the very individuals tasked with upholding truth and justice—law enforcement officials and prosecutors—who lose sight of their obligations and instead fixate on securing convictions. Exonerated cases uncovered by DNA testing reveal troubling evidence of negligence, fraud, or misconduct by those in power.

These alarming trends highlight the urgent need for reform in how testimony is evaluated and how justice is administered. We must advocate for a system that safeguards the innocent and holds accountable those who fail to uphold the principles of justice.

This petition is not just about Jennifer; it is about all those who have suffered under a flawed system. We must demand reform to ensure that no one else endures the pain of an unjust conviction due to coercive practices and unreliable testimony.

We, the undersigned, call for an immediate review of Jennifer’s case, the re-examination of the evidence, and the abolition of coercive plea agreements that compromise the integrity of our justice system.
