End Discrimination Against Men in Child Custodial Rights
The Issue
This petition stems from a deeply personal struggle - my children have been used as leverage against me, the money I provided through the courts did not help prepare them for life, college, or career, but instead caused irreparable damage to my family's mental health, including my two daughters. This is not just my battle, but a shared suffering experienced by numerous men, who are demonized and criminalized for being natural parents due to an imbalanced system.
There exists an alarming inequality in the custodial choices available to men . Currently, men who are unable or unwilling to care for a child face reprimand, prejudice, and discrimination. The men who are will, which represent the majority of fathers, are criminilzed and detached from their own children. This is not only a blatant disregard of parental rights but also a failure to uphold The United States Constitution. Compounding this issue is the substantial lack of mental health resources, contributing to the stark statistic that men account for almost 80% of suicides nationwide.
1) We call on the U.S Government to execute a nationwide state audit of all parental enforcement agencies to identify any instances of fraud, waste, and abuse. Our children are not pawns for extortion but individuals deserving of a just and fair system that prioritizes their well being above all.
The issue here is close to my heart as a father who strongly believes in the vital importance of every child's education and skill development. Many fathers like me are in a battle where custodial agreements are intentionally disrupted, causing significant long-term repercussions on the development and education of our children, all for blatant leverage or vendetta-driven motives.
Such disruptions include switching of schools without mutual consent, non-completion of sports programs, school activities, and cutting off access to trade skill opportunities. The absence of any substantial enforcement or accountability measures allows such breaches to persist with impunity.
According to the US Department of Education, regular school attendance, participation in sports and extracurricular activities, and consistency in learning environments are essential for a child’s academic success. Frequent school changes can negatively impact their education, leading to poor grades and a higher risk of dropout (U.S. Government Accountability Office, 2010).
Recurrent breaches of custody agreements and intentional sabotage of a child's education should not go unchecked. Similar situations have negatively affected many fathers and, more importantly, their children. The time for change is now.
2) We call upon the judiciary to enforce strict reprimands for such disruptions of custodial agreements, expedite relief of custody in the event of clear educational or skill-forming sabotage. It is critical to underscore that this is not just an issue about the rights of fathers, but fundamentally about the rights and future of our children. As a concerned parent, I have watched with growing anxiety as my children's health has been compromised due to a flawed child support system. It emphasizes income over the actual nutritional needs of our growing children. Therefore,3) I urge policymakers to rethink child support guidelines.
Today's guidelines, primarily based on the earnings of the noncustodial parent, disregard the reality of raising a healthy child. They fail to consider the essential concept of nutrition, which needs to be a shared concern between both parents, not an obligation pushed onto one of them by a bureaucratic system that oversimplifies a family's needs.
4) We believe child support should be calculated considering each child's unique nutritional requirements, as indicated by their Body Mass Index (BMI), not solely based on what one parent earns. The World Health Organization indicates that correct nutrition in early childhood is a cornerstone for lifelong health. Sadly, our system covets the simplicity of considering only earning and disregards the multidimensional aspect of child-rearing.
Drawing from my personal wrestling with the health of my children; their well-being has been at risk from a very young age. We, as parents, have witnessed an alarming increment in health-related issues amongst our kids, both in our families and within the broader society. We are losing the grasp of the health of our children partly due to our current family court systems. This isn't an isolated predicament, and we're not alone in this fight.
The American Heart Association states that more than one in three children and teens were overweight or obese in 2012. This indicates an alarming rate, the implications of which, if unchecked, could stunt the potential of an entire generation. For example, obese children are more likely to have risk factors for cardiovascular disease and are at more significant risk for diabetes.
The distribution of welfare aimed at improving the health of families, especially children, has been misdirected. Instead of providing access to healthy and nutritious food, these resources often end up used for junk food, thereby worsening the already dire health statistics.
5+6) We propose two main changes to rectify this situation. First, welfare benefits should be restricted from purchasing unhealthy food for children without parental consent. The stipulations of welfare distribution should encourage healthier choices and preferably require consent from a guardian.
Secondly, welfare for families with children should be distributed equally in deduction to child support, rather than prioritising unhealthy food purchases. Child support deductions should be allocated fairly to ensure they aid the child's holistic well being and not just in securing junk food, which contributes little to their health.
