Amend OUR Constitution to Ban ALL Bans on Activities Not Proven to Harm Others

Tired of fighting brutal “entitled” billionaires who are funding bans on YOUR rights?

A "ban all bans" amendment will free Americans from fighting for our rights and allow us to once again simply enjoy our rights, protecting all Americans and our children now, and future generations forever.

Currently armies of activists are forced to battle a well-organized cabal of “culture war” billionaires who have been unleashed by Citizens United to massively fund the campaigns of lawmakers who restrict rather than protect the rights of their fellow citizens.

No one is safe in a country where lawmakers can ban ANYTHING at any time even if the banned activity has not been proven to harm others.

And even when anti-ban activists succeed in repealing a ban, a win is no insurance against lawmakers re-enacting bans as was seen on the right to abortion.

A “Ban ALL Bans” amendment will allow lawmakers to enact reasonable regulations on activities not proven to harm others within the framework of the U.S. Constitution, as long as the regulations do not amount to a defacto ban.

Paraphrasing the words of President Theodore Roosevelt, our Constitution guarantees Americans the freedom to lead our lives as we desire, provided we do not wrong our neighbors in so doing.

We respectfully call for the introduction of a bi-partisan Joint Resolution to amend the Constitution in the 119th Congress of the United States of America.

Senators and Members of Congress who heed our call to vote to approve the proposed Joint Resolution need not indicate their own opinion as to the proposed Amendment’s ratification or rejection.

A Yay vote indicates only their belief that a question of such vital importance to the safety and well-being of every American should be voted on by the citizens.

America has a successful model of how to end government overreach in the wildly popular 21st Amendment.

The 21st Amendment banned lawmakers  from banning alcohol, ending “Prohibition.”

In just one year and one day, the 21st Amendment achieved passage by two-thirds of Congress and the Senate and ratification by three-fourths of the states using the “state convention” method.

The 21st Amendment set a precedent for the use of the "state convention" method of ratification. 

The “state convention” method of ratification gave voters nationwide a direct voice on repealing the Federal ban on alcohol, and when given a choice, Americans voted resoundingly to ban the ban on alcohol and restore freedom.

The "state convention" method of ratification is one of two methods of ratification that are laid out in the body of our Constitution.

Both methods require approval of a Joint Resolution by a two-thirds vote in the Congress and the Senate.

An approved Joint Resolution calling for the “state convention” method of ratification requires that each state hold a special election to give voters the right to vote yes or no to ratify or reject a proposed amendment.

The state convention ratification process puts the decision into the hands of the voters.

PROPOSED “BAN ALL BANS” AMENDMENT LANGUAGE:

JOINT RESOLUTION

Proposing an Amendment to the Constitution of the United States to Ban the Enactment and Enforcement of Bans on Activities Not Proven to Harm Others 

Resolved by the Senate and the House of Representatives of the United States of America in Congress assembled (two thirds of each house concurring therein), 

That the following article is hereby proposed as an amendment to the Constitution of the United States, which shall be valid to all intents and purposes as part of the Constitution when ratified by state conventions in three fourths of the states:


—ARTICLE—


“SECTION 1. Any existing law that bans or restricts to such a degree as to create a “defacto” ban of any activity that has not been proven to harm others is hereby immediately repealed and may no longer be enforced as of the ratification date of this amendment.


“SECTION 2. Lawmakers may enact reasonable regulations of activities that are not proven to harm others within the framework of the Constitution but may not enact regulations so restrictive as to constitute a “defacto” ban.


“SECTION 3. This Article shall be inoperative unless it shall have been ratified as an amendment to the Constitution by three-fourths of the states in special “state convention” elections held in each state as provided for in the Constitution.”
