Amendments to the Access to Information Act (Canada)
Le problème
This petition is to do justice to Amélie Akerley, a 14-year-old girl who died in a car accident on August 15, 2017. Multiple events surrounding her death make mourning impossible for family and friends. In addition to the various lawsuits initiated to denounce the shortcomings of various parties involved in the file, the family cannot access the RCMP file in order to know all the details surrounding her death in order to support the legal proceedings and above all, to be able to turn the page on the sad events of three years ago.
Indeed, the Access to Information Act (RSC (1985), c. A-1), Canada (2020), protects the information of files under investigation, even if it concerns a minor. This goes as follows:
“Law enforcement and investigations 16 (1) The head of a government institution may refuse to disclose any record requested under this Part that contains : (a) information obtained or prepared by any government institution, or part of any government institution, that is an investigative body specified in the regulations in the course of lawful investigations pertaining to, (i) the detection, prevention or suppression of crime, (ii) the enforcement of any law of Canada or a province, or (iii) activities suspected of constituting threats to the security of Canada within the meaning of the Canadian Security Intelligence Service Act, if the record came into existence less than twenty years prior to the request; "
The purpose of this petition is therefore to lift the restrictions on access to information under paragraph 16 (1) of the Access to Information Act (Canada, 2020) among minors for the dependent.
