The Issue

*PETITION FOR THE AMENDMENT OF ACT 539 OF 2017 TO ABOLISH LIFE WITHOUT PAROLE SENTENCES FOR YOUNG ADULTS AGED 18-20* To the Honorable Members of the Arkansas Legislature, We, the undersigned, call upon you to acknowledge the significance of brain development in determining just and appropriate sentencing for young adults. It is with deep personal conviction that we petition for the amendment of Act 539 of 2017, which grievously permits life without parole sentences for young adults over 17 years of age. This policy ignorantly overlooks the developmental science that distinguishes these young individuals from their older counterparts. Decades of research have consistently reinforced that the human brain continues to mature throughout the early twenties. According to the American Academy of Child & Adolescent Psychiatry, the prefrontal cortex, which governs judgment and decision-making, does not fully develop until approximately the mid-20s. This lack of development makes younger individuals more susceptible to peer pressure, impulsive behavior, and poor decision-making and is why legal age limits exist for activities such as alcohol and tobacco purchases. Recognizing these developmental differences, the United States Supreme Court has progressively reformed juvenile sentencing, concluding life without parole for juveniles to be a cruel and unusual punishment. Despite this, the gap between those protected under such reforms and individuals aged 18-20, who are equally vulnerable, has been left unaddressed—until now. Act 539 of 2017 exposes these young adults to the harshest sentencing measures—a life without the possibility of parole. This represents not only a grave injustice but also a blatant disregard for the developmental facts at hand. It ignores the potential for growth, change, and rehabilitation that every young person inherently possesses. With this petition, we urge you to:

1. Amend Act 539 of 2017 to include young adults aged 18, 19, and 20 within its protective scope.

2. Apply this amendment retroactively, aligning the justice system with current scientific understanding and providing hope and the opportunity for rehabilitation to those already affected. It is our moral imperative to embrace a more humane and scientifically informed approach to justice. We must recognize the significant differences between young adults and fully matured individuals when adjudicating sentences. Doing so respects both the individual's capacity for change and society's responsibility to rehabilitate rather than discard. By signing this petition, we collectively stand against inhumane sentencing for our young people. We urge you to act with compassion, wisdom, and courage, amending Act 539 to reflect our shared values and trust in the power of redemption. Thank you for your attention to this critical matter.
