What we are calling for

  1. Reform of Australia’s OPCAT National Preventive Mechanism legislation to recognise ‘functional detention’ as a monitorable setting in police-led mental health emergency operations, and to require real-time independent monitoring through police body-worn cameras integrated with external clinical and legal oversight.
  2. Provision of Commonwealth and State funding to support implementation and ensure consistent national delivery of the Operation WATCH OVER ME pilot, including the establishment of clear standards for real-time independent monitoring in police-led mental health emergency operations through police body-worn cameras, with integrated clinical support and National Preventive Mechanism oversight.

Why it matters

When the State exercises powers that control or detain a person in acute mental distress, a clear duty to protect life arises. That duty extends to the person in crisis, to the public, and to the police officers and other first responders involved.

Lives are not protected by reviews conducted after a death. Prevention requires support and oversight at the point of contact, including real-time supervision, access to clinical advice, and independent monitoring.

Absent reform, preventable deaths will continue, and Australia will remain short of its legal and human rights obligations.
