How unfortunate it has gotten to this point when inmates are brutalize and murdered by the hands of officers whom are criminal themselves getting away with their horrific actions and remain on the force by the city and state who keeps them employed when they should be fired and charged with assault, battery, and murder. Governor Hochul please take immediate actions regarding these horrific horror stories on humanity. It must stop and you have the power too put an end to it. So many people lives at the hands of these officers are at a deadly state of mind. We the families and the people of New York city are counting on you to do the Right thing!! They deserve Justice.

On September 24, 2024, my brother Juan Rivas was assaulted, tortured, kidnapped and abused for several hours. His wife made several attempts to contact him at the prison and they claimed that he was in "observation". His wife has HIPAA forms and POA and requested explicit information of his whereabouts. After contacting the department of corrections and threats of contacting news, my brother finally was put in a SHU box and given a phone call on October 4, 2024. He stated that he was, tortured, kidnapped for several hours and beaten. His wife Marie Rivas went into action and contacted our attorney, OSI, PREA and Albany to put a complain. At this time the COs were now given him what he was supposed to in order to alleviate his wife's call to OSI and other officials.
On October 8, OSI went to have the conversation with my brother in which my brother gave explicit details of what had occurred with him throughout the course of September 24, 2024, through October 4, 2024. His wife contacted the prison to inquire as to why my brother had not called in as she was afraid for his safety and had expressed such to Albany, OSI and PREA. His wife spoke to Ms. Ballou at Marcy Correctional Facility who explained that he was in a meeting with OSI and that he would NOT be calling me today. She explained that although he was with OSI he should still receive his other call at 7pm and should not be retaliated against. Again Ms. Ballou stated that it was not mandatory and that he would call her soon.
My sister-in-law contacted the prison for 4 days. On October 10, she spoke to Ms. Amy in mental health who now stated that he was in observation. His wife explained that it was where he was assaulted and beaten. Ms. Amy along with Mr. Kinkade explained that he was not in a "security observation" that it was a medical observation. She asked several times if he was ok and was assured, he was. On Friday, October 11, his wife received a call from Wynn Hospital at Utica that my brother Juan Rivas would need emergency surgery for 4 (four) broken ribs due to being assaulted at Marcy Correctional by officers and that they would know more after the surgery. The prison never notified us and never told us what was happening with him.
Upon calling the hospital we were met with hang ups and disrespect and stern "nos" of visits.
Today I visited my brother after several attempts at Wynn Hospital where in addition to have broken ribs he suffered a hemorrhage and was now in ICU as he almost died due to internal bleeding. That he was again assaulted, beaten and tortured for retaliation of his wife's efforts.
