The NSW Director of the ODPP (Office of the Director of Public Prosecutions), Lloyd Babb has seen fit not to prosecute two men who, it is alleged, raped and murdered a mother of seven on a Northern NSW beach in January, 2011.
It is reported here on 9news.com.au that "Adrian Attwater, 42, and Paul Maris, 46, both admitted to having sex with a woman, only identified as Norma, on a beach on the NSW north coast on January 27, 2011 but claimed it was consensual, The Daily Telegraph reports.
After the encounter in the back of a vehicle on a beach near Iluka the men burned a blood-soaked mattress and some of the 33-year-old woman's clothes before seeking help.
A forensic pathologist who examined Norma said the injuries she sustained "were more severe than those which occur in even precipitous childbirth".
It was also reported in the same article that "Following a 2014 inquest State Coroner Michael Barnes referred the men to the DPP but the DPP's director Lloyd Babb has refused to charge them.
The inquest found that both men had lied about what had occurred on the evening of Norma's death and with a blood alcohol level of 0.35, she would have been too drunk to consent to sex."
If Norma was too drunk to consent to sex, that is rape. Norma was left bleeding and died from her injuries. If someone dies from the result of injuries sustained during rape wouldn't you class that as murder, or at the very least, manslaughter?
