According to the constitution under Code 18 U.S.C. Section § 922(g)(3), The mere possession of a valid Medical Marijuana Card and/or the use of medical marijuana, makes a citizen an “unlawful user of or addicted to any controlled substance. This is not correct, or constitutional. Under federal law, yes Marijuana is considered a controlled substance and a drug. BUT, many states now are considering it as a MEDICINE. Marijuana is merely an herb that can be grown in people's yards. The issue with all of this, is that the government still believes that Marijuana/Cannabis is considered a drug.The government does not want to accept the fact that it is a medicine. Many doctors are just supporting "pill pushers". They give patients pill after pill, to compensate for the side effects of each one prescribed. Many prescribed are drugs themselves. The literal definition of a drug is "a medicine or other substance which has a physiological effect when ingested or otherwise introduced into the body". Anyone having a firearm can be taking a prescribed drug but it is considered a "medicine". What is the difference between them? Nothing. Under Section "27 C.F.R. § 478.32.11." This explains that "a person possessing a Medical Marijuana Card, is prohibited by federal law from the purchase or acquisition, possession, or control of a firearm, any person who uses or is addicted to marijuana, regardless of whether his or her State has passed legislation permitting marijuana use for medicinal purposes, is an unlawful user of or addicted to a controlled substance, and is prohibited by federal law from possessing firearms or ammunition" This is Unconstitutional, because it is unknown if any person is "addicted or abuses" any sort of prescribed drug. They can be addicted to any other "drug", but it makes it okay, because the government still believes that Marijuana does not have any positive effects on people and believed to be a "controlled substance" like (cocaine, meth, etc...). The government needs to realize that, Marijuana is not a drug, it has many positive outcomes for patients with (Anxiety, PTSD, Tremors, etc..). Many people have negative side effects from drugs that are prescribed by doctors, but yet they try Marijuana and realize that, it is beneficial for them. Many pills prescribed are addictive, such as xanax, and instead of prescribing something addictive, or they patient refuses to further take the medication. They use Marijuana as an alternative, because it has positive outcomes and beneficial for them. Marijuana should not be considered a drug anymore. It has beneficial properties for many people suffering from a plethora of illnesses such as and not limited to from mental disorders and pain management. Having a medical Marijuana card (license) should not inhibit a citizen from obtaining and owning a firearm. This goes against the 2nd amendment. So, join me in helping the transition from Marijuana being a "drug" to now being a medicine that is beneficial to people and should not inhibit someone from obtaining an object that they are Constitutionally able to own.
