The Issue
All Alachua County voters should support this petition as they could easily find themselves in a similar situation. The Code was deficient in that it did not properly address "grandfathered in" property rights. A misguided Code enforcement officer didn't do his homework. While a mere witness at a Code Enforcement Board hearing, this 93 year old Pearl Harbor veteran was summoned to the microphone and charged on the spot with a code violation, without counsel, and without the ability to prepare or put on any defense. Through this series of mishaps his business of some 35 years was forced to close. He had to obtain legal counsel and although they immediately met with the County, it took three months, three hearings, three meetings, extensive research, countless telephone calls and approximately $40,000.00 in legal fees to get the County to finally listen, drop the charges against him and to work on a Code revision. This could have been remedied by the County on day one. If the County has to pay these fees it will be less likely another individual will suffer the same fate.
