落實「動物福利法」及爭取動物權益聯署 / Petition for Strengthening Animal Welfare Laws in Hong Kong

多年來香港不斷發生殘害對待動物事件 (懷疑毒狗案湧現 寵主點自救?),包括放置捕獸器、落毒及疏忽照顧動物導致死亡等。我們要求政府修訂動物福利相關的法律及政策,將虐待動物兇徒繩之於法,以保障動物權益,讓香港成為「人寵共融」,動物友善城市。
我們的倡議:
1. 徹查虐待動物案件,嚴懲兇徒
本港接連發生多宗嚴重虐待動物案件,包括設置非法捕獸器及投毒個案,更有兇徒斬貓頭祭祀和蒙頭虐殺貓貓等。
更令人憂慮的是投毒地點多選在民居附近的街道或公園,不僅危害動物生命,更可能威脅市民生命安全(特別是兒童)。
我們促請當局高度重視此類案件,加強巡查執法,將兇徒緝拿歸案。
2. 加重法例罰則,提升阻嚇力
鑑於現行法例對虐待動物的刑罰過輕,容易令公眾誤以為殘酷對待動物罪行輕微。我們建議大幅提高刑罰,根據立法會文件 (LC Paper No. CB(2)1381/18-19(03)) 的建議,將最高監禁刑期由現時的三年增至七年,最高罰款則由二十萬元提升至一百萬元。同時,建議將量刑起點定為十二個月或以上,以確保刑罰能切實反映罪行的嚴重性。
對於嚴重案件,我們建議法庭可按情況判處已定罪人士喪失飼養動物的權利,藉此彰顯罪行的嚴重性,加強刑罰的阻嚇力。
3. 重新檢視《防止殘酷對待動物條例》
現行的《防止殘酷對待動物條例》(第169章)已過時,其條文內容已不符合現今社會對動物權益的期望。我們強烈建議以更全面的《動物福利法》取而代之,並將「謹慎責任」原則納入核心法律框架。根據立法會文件 (LC Paper No. CB(2)1381/18-19(03)) 的建議,謹慎責任的概念包括a)需要有適當的營養飲食;b)需要有合適的環境;c)需要能夠表達出正常模式的行為(包括社交需要);以及d)需要受到保護,免受痛楚、痛苦、疾病和傷害。
同時,建議將遺棄動物同樣視為違反照顧者謹慎責任,亦會觸犯法例。
4. 制定完善的動物福利發展藍圖
儘管《動物福利法》的公眾諮詢已於2019年展開,惟至今仍未完成立法。現時本港的動物相關法例分散於不同條文之中,且未以保護動物為首要考慮,難以配合社會對動物權益的期望。我們促請政府制定全面的動物福利藍圖,當中應包括:
a. 擴大保障範圍至流浪動物及野生動物;
b. 建立長遠而有效的流浪動物管理政策,例如有系統的絕育計劃和為動物植入晶片及接種預防針;
c.重新審視「人道毀滅」的準則及程序,長遠做到「零人道毁滅」;
d. 引入飼者扣分制;
e. 加強推廣動物保育意識 等等。
5. 倡議建設動物友善城市
我們建議香港推動動物友善政策,透過加強公民教育,提升寵主飼養責任意識及推廣動物共融社區概念,亦可透過寵物友善提振經濟。
我們建議繼續檢討及調整現有政策,例如:a. 修訂食環署規例,容許食肆自行決定是否接待攜帶寵物的顧客,及b. 研究放寬公共交通工具對寵物的限制 c. 倡議開放部分公屋為寵物友善 公屋 等等

Years of repeated animal cruelty in Hong Kong have included trapping, deliberate poisoning (Animal welfare in Hong Kong), and neglect that has led to the deaths of many animals.
We urge the government to amend existing animal welfare laws and policies to ensure stronger animal protection, take swift action in investigating these crimes and bringing perpetrators to justice, and strengthen animal welfare efforts, making Hong Kong a truly animal-friendly city where humans and animals can coexist harmoniously.
Our Demands:
1. Thorough Investigations into Animal Cruelty Cases and Prosecute the Offenders
Repeated incidents of animal cruelty have been reported across Hong Kong, including illegal animal trapping, beheading of cats for sacrifices, and brutal killing of cats with their heads concealed. Poisoning cases, in particular, have occurred in residential areas, public parks, and streets, posing a significant threat not only to animals but also to public safety, especially children.
We urge the authorities to take these incidents seriously, step up enforcement efforts, and prosecute the offenders.
2. Strengthening Legal Penalties for Animal Abuse
The current penalties against animal abuse are insufficient, conveying the inaccurate impression to the public that cruelty to animals is a minor offence. In alignment with recommendations from the Legislative Council document (LC Paper No. CB(2)1381/18-19(03)), we propose increasing the statutory maximum imprisonment for animal abuse from three to seven years and raising the maximum fine from HKD 200,000 to HKD 1,000,000. We also demand a minimum 12-month sentence to ensure the severity of the crime is appropriately addressed.
For serious offences, we also propose to impose restrictions on convicted abusers, including temporary or permanent bans on animal ownership, to emphasize the severity of the crime and reinforce deterrence.
3. Reviewing the Prevention of Cruelty to Animals Ordinance (Cap. 169)
The current Prevention of Cruelty to Animals Ordinance (Cap. 169) is outdated and fails to provide comprehensive protection for animal welfare in the modern era. We propose the enactment of a comprehensive Animal Welfare Law mandating a clear "duty of care" principle for pet owners, as outlined in Legislative Council documents (LC Paper No. CB(2)1381/18-19(03)). This includes providing the need a) for suitable nutrition, b) for a suitable living environment and necessary veterinary care, c) to be able to exhibit normal patterns of behaviour (including social needs), and d) to be protected from pain, suffering, disease and injury.
Additionally, animal abandonment should be considered a breach of duty of care and be criminalized.
4. Establishing a Blueprint for a Long-Term Animal Welfare Roadmap
The public consultation on Proposals to Enhance Animal Welfare in Hong Kong (LC Paper No. CB(2)1381/18-19(03)) began in 2019, yet legislation has yet to be enacted. Hong Kong’s animal-related laws are fragmented across multiple ordinances, failing to offer systematic protection for animals that meet modern standards.
We urge the government to establish a long-term animal welfare roadmap, which should include:
a. Extending legal protections to stray and wild animals;
b. Establishing long-term and effective policies for stray animal management, including systematic neutering programs, microchipping, and vaccinations;
c. Revisiting policies and protocols on "euthanising animals" with the long-term goal of achieving “zero euthanasia”;
d. Introducing a pet owner demerit point system to regulate responsible pet ownership, and;
e. Implementing educational strategies to raise public awareness of animal conservation.
5. Advocate for an Animal-Friendly City
We call upon Hong Kong to implement more animal-welfare-centric policies. Promoting responsible pet ownership and fostering a culture of coexistence with animals through strengthening public education. This pet-friendly approach may also boost economic activity.
We advocate for the continuous review and adjustments of applicable policies, such as a) revising Food and Environmental Hygiene Department (FEHD) regulations that would permit restaurants to establish their pet accommodation policies, b) relaxing public transportation restrictions on pet-friendly transportation policies, c) advocating designated public housing as pet-friendly to support responsible pet ownership.
