A Public Petition for Accountability: Why Has the Countering America's Adversaries Through Sanctions Act (CAATSA) Still Not Been Applied to Algeria?
To:
The President of the United States and the Federal Administration
The United States Congress, both the House of Representatives and the Senate, in particular the committees on Foreign Relations, Foreign Affairs, Armed Services, and Banking
The U.S. Department of State, the agency legally responsible for implementing Section 231 of the Act
The U.S. Department of Defense (the Pentagon)
The U.S. Department of the Treasury and its Office of Foreign Assets Control (OFAC)
Petition initiated by: Dr. Mac Sharkawy, political analyst and attorney
I. Legal Basis
In 2017, Congress enacted the Countering America's Adversaries Through Sanctions Act (CAATSA). Section 231 requires the President to impose at least five of the twelve sanctions listed in Section 235 on any person who knowingly engages in a "significant transaction" with the defense or intelligence sectors of the Russian Federation, chief among them Rosoboronexport.
The United States has enforced this provision before: against China in 2018 for its purchase of Su-35 fighters and the S-400 system, and against Turkey, a NATO ally, on December 14, 2020, for its S-400 acquisition.
II. Documented Facts
In 2021, Algeria concluded an arms deal with Russia worth more than $7 billion, including Su-57 fighters, according to the official letters issued by Members of Congress in 2022.
On September 14, 2022, Senator Marco Rubio, now Secretary of State, urged then-Secretary Antony Blinken to impose sanctions on Algeria under this very law.
On September 29, 2022, 27 bipartisan Members of Congress, led by Rep. Lisa McClain, called for "immediate" sanctions, describing Algeria as the third-largest recipient of Russian arms in the world.
On February 12, 2025, Algerian state television confirmed that Algeria is the first foreign buyer of Russia's Su-57 fighter.
In March and April 2025, satellite imagery showed Su-35 fighters in Algerian Air Force markings at Oum El Bouaghi Air Base.
In November 2025, Russia's United Aircraft Corporation announced delivery of the first two Su-57s to a foreign customer, identified in defense reporting as Algeria.
On February 3, 2026, Robert Palladino of the State Department's Bureau of Near Eastern Affairs told the Senate Foreign Relations Committee that these deals are "concerning" and may trigger the law.
Most serious of all: the S-400 — the very system for which Turkey was sanctioned. Russian media reported that Algeria signed a deal for the S-400 in 2021. In late May 2025, the Algerian People's National Army officially displayed the S-400 for the first time during the live-fire tactical exercise "Steadfastness 2025" (Al-Sumoud 2025), in footage showing its launchers and a missile striking an aerial target, with Chief of Staff General Saïd Chanegriha observing; Algeria's official state news agency covered the drills. In other words, the Algerian government itself published the evidence.
Despite all of this, as of the date of this petition, no designation or sanction against any Algerian entity under Section 231 has been publicly announced.
III. Our Demands
We, the undersigned, call for the following:
That the Department of State, in consultation with the Treasury, issue a public determination on whether Algeria's arms transactions with Russia since 2017 constitute "significant transactions" under Section 231, and, if not, explain the legal basis for that conclusion.
That the Administration disclose whether any waiver or deferral has been granted for Algeria, with its justification, issuing authority, and date.
That the relevant congressional committees hold public hearings on the reasons for non-enforcement and require a formal written report from the Administration within a set deadline.
That the Pentagon provide an assessment of how these acquisitions affect the military balance in North Africa and the Western Mediterranean, the security of U.S. partners in the region, and NATO's southern flank.
That the Treasury clarify the financial channels through which payments for these deals reached sanctioned Russian entities.
That the law be applied to all with a single standard, as it was to Turkey and China, because selective enforcement erodes its credibility and America's deterrent power.
IV. Conclusion
A law passed by Congress with an overwhelming majority is meaningless if it remains ink on paper. We, citizens, residents, and friends of the United States, ask for a clear and public answer to one question: why has the law still not been applied to Algeria?
