Neighborhood Petition Against Developing 1226 S 50th St

The neighbors of 1226 S 50th St are opposed to the development of a multi family household structure. Our block has always been a tight-knit community of single family homes and we find that a multi family structure would "sacrifice the character of the neighborhood". We are opposed to it for the following reasons:

1. It does not meet the "unnecessary hardship standard" which it must prove in order to qualify for a variance.

1a. There are unique physical conditions on the property:  False. 1226 is a regular, middle of the block, standard-sized lot.

1b. The variance is necessary for viable economic use of property. False. A single family building could be erected if need be and could be sold as such. The lot could also be a community garden and produce could be sold from it. 

1c. The variance does not alter the consistency/ character of the neighborhood. False. The character of the neighborhood has always been 1 house 1 family, and this is what has lent to a very tightly knit community culture. As a side note, the entire rest of the block of S 50th St is only 2 stories and this proposal is 3 stories. 

1d. The variance does not impair the appropriate use or development of adjacent property and does impose negative consequences on the welfare of the community. False. 1226 being multifamily would negatively impact the welfare of the community by making an already crowded parking situation worse, potentially even adding up to 6 cars for two or three families. Furthermore, the adjacent lot 1224 has been used as a community garden for more than a decade and the development of 1226 will negatively impact this use. 

2. The proposed development is prohibited by the zoning code for the RSA-5 district; Table 14-602-1: “Whereas the proposed use of multi family household living is prohibited in the RSA-5 zoning district”

We the undersigned are strongly opposed to this proposal to develop 1226 S 50th St into a multi family building.
