Bribes, Car, Prostitutes, Retaliation against Whistle Blower

The Issue

My brother, Kim-Wing Long was fired for whistleblowing.   There is no law against whistleblowing retaliation in Singapore.  

My brother was the Regional Director of Finance at Xcerra Corp’s Singapore subsidiary called LTX-Credence and was appointed the Director of a few of their Asian subsidiaries.   He had worked for the company for more than 20 years. Xcerra Corp is a publicly traded company headquartered in Boston, USA with subsidiaries  in Asia.

It became apparent to my brother that two of Xcerra’s Vice-Presidents were accepting bribes in the form of a heavily discounted car ($1,500 versus a normal retail price in Singapore of $80.000), wine, Cuban cigars and the provision of prostitutes during their trips to Asia.   These bribes were offered by vendors, Apogee and Jabil who in turn were given special preferences over other vendors.    

The executives accepting such bribes are Tom Young, VP Operations and Tony Miola, VP Manufacturing .

My brother reported their malfeasance to his boss based in the U.S., Dan Wallace, VP of Finance who then reported it to the Corporate Counsel, Joe Hedal who further reported it to Xcerra's CFO and CEO.   No action was taken by Xcerra on the malfeasance raised.  

Instead, my brother, along with fellow whistleblowers Dan Wallace and Joe Hedal were summarily dismissed.   Subsequently, my brother filed a lawsuit for wrongful dismissal in Singapore.   The company's legal counsel in Singapore has engaged in various tactics to delay court proceedings and frustrate my brother's lawsuit, further draining his finances with legal fees.    

Postings on Xcerra's Yahoo Finance message board about this issue were taken down by Xcerra.   All of Xcerra’s Investors conference calls were staged with pre-assigned callers and questions.   Other callers were not allowed to raise questions.  

Please join me in asking Roger W. Blethen, Chairman of Xcerra's Board of Directors and David G. Tacelli, CEO  to stop penalizing my brother for speaking the truth and to stop delaying his lawsuit.    This petition is our last resort for righting a wrongful dismissal after more than 20 years of working for the company.
