Despite serious concerns raised by many of its students, Western Sydney University has decided to conduct end-of-semster exams using the controversial and highly invasive services of ProctorU.
While the majority of Australian universities have managed to devise ways to conduct end-of-semester exams without such services, Western Sydney University continues to pursue this method.
The University is forcing its students to accept the terms and conditions of ProctorU and in doing so, permit ProctorU to access their computers, install software and, most concerningly, collect, store, process and share video, audio and bio-metric data of each student using the service.
The Content you submit, post, or display, including all audio and video recordings or images, including any recordings or images of you made by the Services during your test session(s), will be shareable with and viewed by your Testing Institution…...ProctorU is not and will not be responsible or liable for how your Testing Institution chooses to use your Content
...ProctorU will remotely connect to your computer in order to monitor your computer screen and premises…..you agree to scan your premises using your webcam if or when a proctor request that you do so. ….You agree to maintain audio and video contact with the proctor during the test session…..You authorize us to make all recordings of and any Content from your examination or test session available to your Testing Institution.
Neither ProctorU nor its vendors, affiliates, or any person associated with ProctorU makes any warranty or representation with respect to the completeness, accuracy, availability, timeliness, security, or reliability of the Services or any Content therein.
ProctorU does not assume any liability for loss or damage to your computer systems, devices, or networks as a result of your use of the services. ProctorU will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses, or other technologically harmful material that may infect your computer equipment, computer programs, devices, or data due to your use of the Services.
...you must download our browser extension…you must provide us with access to your device’s camera and microphone and share your screen with our proctors through a LogMeIn File...we use that ID in conjunction with biometric facial recognition software to authenticate your identity. We also require you to perform a biometric keystroke measurement for some exams.
We may disclose information, including video and audio recording of your exam session, to your educational institution/certifying entity upon request.
We may engage certain trusted third-parties to help optimize our website and assist with our testing services. We share your personal information with these third-parties only to the extent necessary for them to perform the functions we have requested.
ProctorU may transfer information to a third party in the event of a bankruptcy, merger, acquisition, reorganization, or similar transaction.
We retain information for as long as necessary to perform the Services described in this Policy, as long as necessary for us to perform any contract with you or your institution, or as long as needed to comply with our legal obligations.

We believe that Western Sydney University's decisions violates an individual’s right to protect their own privacy. We also believe that in forcing students to agree with the Terms Of Service of ProctorU, Western Sydney University is breaking the law by forcing students to enter into a contract whose terms they may not accept.
