Public Update – Court Injunction Proceedings Now Issued

Thank you to everyone supporting this petition. We wanted to share an important update based on information provided by North East Derbyshire District Council.

The Council has confirmed that it has now issued injunction proceedings relating to the outstanding works at:

Northfields, Shirland
Williamthorpe Drive, North Wingfield
Copper Beeches, Tupton

All three applications have been listed at Chesterfield County Court Tapton Ln, Chesterfield S41 7TW on 15 September 2026 at 2:30pm.

According to the Council, the Defendant companies have indicated that they intend to contest the applications and have asked for additional time to prepare their evidence. A proposed timetable (known as “directions”) will be put before the Court to help manage the next stages of the case. This includes requirements for the Defendants to provide documents, identify outstanding works, explain funding arrangements, and set out updated programmes for each site.

The Council has also confirmed that:

No physical works were carried out at any of the three developments between the Council’s inspections on 2 June and the Defendants’ update on 4 September.
Funding for the outstanding works is not currently secured or immediately available, based on the Defendants’ own statements.
The Council is seeking a Court‑controlled timetable to ensure progress continues.
The hearing on 15 September is expected to focus on case management rather than the final decision. The Council has said it will provide a further update after the hearing, and we will share that with supporters as soon as it is available.

The hearing is presently expected to take place in public. Any resident wishing to attend should check the hearing arrangements directly with Chesterfield County Court beforehand, as attendance, courtroom arrangements and capacity are matters for the Court. Those attending will do so as observers, and the conduct of the hearing will remain under the control of the judge.
