Court Sets Firm Timetable as Residents Await Completion of Unfinished Developments

Planning Enforcement Update
We have received a further update regarding the Council’s planning enforcement proceedings relating to outstanding works at the Northfields, Williamthorpe Drive and Copper Beeches developments.
Following the hearing at Chesterfield County Court on 15 September 2026, the Court set a timetable for the next stages of the three cases. The proceedings will continue under Court supervision, with evidence deadlines during October 2026 and a two-day trial to take place between 11 January and 26 February 2027.
Residents report that neither the developer nor a representative of the defendant companies attended the hearing.
The Court has directed the defendant companies to provide evidence concerning the outstanding works, highway and section 278 matters, contractors, funding, third-party dependencies and anticipated programmes for each development.
In an email to Northfields residents dated 2 March 2026, the developer stated that its objective remained to secure agreement with North East Derbyshire District Council, complete the outstanding works and bring matters at Northfields to a proper conclusion.
Residents report that the developments remain unfinished and appear to be substantially in the same condition as they were approximately a year ago, with residents not aware of any significant completion works having taken place during that period.
The Council has indicated that it hopes the Court-controlled timetable will encourage practical progress and may assist in securing an earlier resolution. The defendant companies remain able to complete the outstanding works before the trial.
Unless the outstanding matters are resolved through completed and evidenced compliance, the Council has confirmed that it will continue preparing the claims for trial and pursuing the injunction orders sought.
We welcome the continued progress of the legal process and remain hopeful that the outstanding works can be completed without the need for a trial. We will provide a further update when there is a material development.
