The environmental group Friends of the Black River Forest (FBRF) has filed a lawsuit to have the decision from the Wisconsin DNR to grant Kohler the wetlands permit reversed because they believe the DNR was not thorough enough in its analysis and granted Kohler the permit despite the potential drastic environmental impacts. The petition has been submitted to the Sheboygan County Circuit Court, according to Attorney Christa Westerberg, who is representing FBRF in court. Case Caption: Friends of the Black River Forest et al vs. Wisconsin Department of Natural Resources Sheboygan County Case Number 2018CV000082 In January the DNR released a Final Environmental Impact Statement (EIS). This was included in the petition and can be found on the official DNR website. The EIS is a summary of the environmental impacts of the proposed project. Besides the incomplete Wetland Permit and Final Environmental Impact Statement, FBRF objects to a DNR which accepted Kohler’s request to use State Park land because it was more convenient for him than going through his own land. Up to 20 acres of park land will be impacted when the entrance is torn up, a road built and 3 maintenance buildings constructed on prime park land. The DNR misrepresents the facts and has no business using a Kohler economic report and inaccurate Kohler environmental information as resources to determine impacts. FBRF has presented expert analysis of the incomplete and inaccurate information for 5 years. This is a blatant giveaway to a well-connected donor which cannot be justified. It is important to note Kohler did not donate this land to the state. It was purchased with federal land and water conservation funds -LAWCON. The land in question must be converted from public to private by the National Park Service. The DNR circumvented this requirement by removing the land from state park inventory.
