The Issue

In 2015, I was the victim of 2 frivolous protection from stalking (PFS) orders in Marion County Ks (15DM41 and 15DM43), one case went to court, where I was vendicated by the judge, the other one was dismissed by the petioner the day before court, after 6 months of having the order in place while waiting for my hearing. There were no threats, no contact, nothing that would make a reasonable person feel their safety threatened. In Kansas, anyone can file a PFS and a hearing should take place within a few weeks. In my case, I was served on June 1st for one case with a hearing date of June 10th. Later in the week I was served for the second case with the same hearing date of June 10th. The two cases were filed as leverage in the divorce case between one of the petioners and my brother in law. On June 10th, both petioners were represented by separate lawyers, I represented myself because I knew the accusations were unwarranted. The lawyers asked for and were granted a continuance, which ended up being pushed out several times, while the entire time I was bound by their false accusations.in at least Oklahoma and Texas, petioners are required to file a complaint with law enforcement before filing the PFS. Law enforcement involvement isn't currently required in Kansas. The judges side with the petioner more often than not in ordering a temporary order, relying on the hearing to sort out all of the information in a timely manner. In my cases, I never got to tell my side of the situation until months later on one case, and never with the second case after waiting 6 months with my 1st and 2nd amendment being denied. I have been an RN for over 16 years and I have my carry conceal license. Both of these licenses were placed in jeopardy at the whim of 2 ex family members. This injustice has to stop. I had no rights during my ordeal. Please help me get the law enforcement complaint requirement in place in Kansas just like it is in Oklahoma and Texas so that further misuse of the PFS may be prevented.
