The Issue
My name is Libby Baity and my only grandson, Wesley Seth was taken from us on May 9, 2023. Wesley was only two years old and so full of life and laughter. Tragically, he drowned in the pool at the at-home day care he attended. Wesley was my daughter and son-in-law's only child and their entire world. Wesley's drowning could had been prevented and these new procedures that I am suggesting will hopefully help others to not have to experience the pain that my family is going through.
As a concerned citizen for child safety and a dedicated grandmother, I write to you today to present a petition urging immediate action on implementing "Wesley Seth’s Law for At-Home Day Care Regulations." This proposed law is crucial to safeguard the welfare of our children in home-based daycare settings and address pressing concerns in the current system.
Who is impacted?
The proposed regulations directly impact various individuals within the realm of home-based daycare. These include:
a) Children: Children are the primary beneficiaries of this law, as it would ensure their safety and well-being in home daycare environments.
b) Parents/Guardians: Parents and Guardians entrusting the care of their children to home daycares deserve the peace of mind that adequate regulations and safety standards are in place to ensure the safety of their children.
c) Home Daycare Providers: By implementing licensing requirements and regular state inspections, this law supports responsible and dedicated home daycare providers, helping them maintain a high standard of care and ensure that the children they are caring for are kept safe.
What is at stake?
The safety and well-being of our children are at stake in home daycare environments. Currently, there is a lack of consistent regulations and oversight, which can potentially lead to substandard care, increased safety risks, and compromised child development. Without appropriate regulations and safety measures, children may be exposed to hazards such as unsecured pools and limited access to specialized support services, placing their lives and well-being at risk.
What changes are being proposed?
It is imperative to take action now to address the pressing issues surrounding home-based daycare and ensure the highest level of safety and care for our children. The reasons for immediate action are as follows:
a) Child Safety: Implementing regulations, licensing requirements, and regular inspections will help create a safer environment for children in home daycares, minimizing potential risks to both children and home care providers.
Minimum safety requirements must include:
* Home daycares with pools to be required to have appropriate safeguards around the pool to ensure that primarily a child cannot fall into the pool and secondarily, in the event that despite appropriate safeguards being in place a child still falls into a pool, that the daycare staff members are immediately alerted
* An AED (Automated External Defibrillator) and the proper training for all day care staff members on how to use the AED on all ages of children they care for
* At least one additional staff member, other than the day care home operator, over the age of 18 to help with any situation that may arise
b) Liability Protection: Requiring higher day-care insurance coverage limits will provide an added layer of protection for both children and daycare providers, ensuring financial recourse in case of unforeseen incidents or accidents.
By enacting "Wesley Seth’s Law for At-Home Daycare Regulations" promptly, we can prioritize the well-being of our children, protect the rights of parents and guardians, support responsible daycare providers, and establish a comprehensive framework that fosters a safe and nurturing environment for all.
