In an monumental ruling from the 5 judge panel Court of the Commonwealth, the Mask Mandate order that was placed on K-12 schools and daycare by Department if Health head, Alison Beam, is unauthorized, void and unenforceable. The school board was made aware in September that this Mandate was not authorized and the Department of Health or Governor Wolf did not have the unlimited authority to go above the law and order a Mask Mandate to the children of Pennsylvania. Solicitor, Bob Frankhouser, has misconstrued not only the Mandate as written which lead to required masks with no exemptions unless signed off by a Doctor, but also the ruling in favor of the parents of Pennsylvania making the Mandate void and unenforceable. An appeal has not yet been filed and a stay has not been granted on the ruling. Therefor the ruling overturning the Mandate stands. The power to allow kids to return to a normal school setting lies solely in the hands of the school board, who like any other reasonable person is following the legal advice of legal counsel. Unfortunately for us, that is Bob Frankhouser. I firmly believe that the first step for a change in the right direction is new representation.
