Stop Eminent Domain Abuse
The Issue
Chapter 15 section 23-15-101 of the Arkansas Constitution states that "All pipeline companies operated in this state are given the right of eminent domain and are declared to be common carriers, except pipelines operated for conveying natural gas for public utility service."
This law was written in the 1920s and is sorely outdated.
We, the undersigned, feel that this antiquated legislation exposes the citizens of our state to abuse by private oil and pipeline companies whose sole purpose is to operate for profit and not the general good of the people of Arkansas. We, therefore, ask that our state legislature support changes that will protect the citizens of Arkansas from eminent domain abuse by pipeline companies and to uphold their constitutional right to property ownership. We believe that better notification and review process reform is critical to protect private property owners.
We further support legislative requirements that protect property owners from intimidation or threats by land acquisition agents working for pipeline companies. Private citizens should be treated with respect and have the opportunity to understand their rights as outlined by the law when dealing with representatives of pipeline companies.
Our goal is not to impede economic or business growth, but to assure that there is conscientious development that is fair to all. The current eminent domain law favors a select few at the expense of unprotected property owners. This law must be changed to allow open forums and proper notification of the intent of a pipeline company and show proof that it is in the interest of the public at large.
