The Issue

Let our SENATORS and GOVERNOR know YOU CARE and want CHANGE!!! 

In honor of our mom who suffered at the hands of a nurse sent by a home health care company in MN to the point of wanting to die, I pledge to help do whatever I can to MAKE A DIFFERENCE and BRING CHANGE TO MINNESOTA!  WE CANNOT ALLOW WRONG DOERS TO BE EXCUSED AND A PENDING PERSONAL INJURY CASE TO "DIE WITH THE VICTIM"! 

Minnesota law ENCOURAGES HARMFUL WRONGDOERS to DELAY, LIE AND DENY when their victims are elderly.  In Minnesota, elderly persons harmed by the healthcare providers they DEPEND on may NEVER see their wrongdoers held legally accountable.  Why?  Because MN law encourages and REWARDS such wrongdoers for delay and deny legal tactics.  

EXAMPLE:  If a nursing home employee RAPES a resident of the facility who then dies from unrelated heart failure, etc the RAPIST AND HIS EMPLOYER ARE RELIEVED OF ANY LEGAL LIABILITY.  THE CLAIM DIES WITH THE VICTIM!

UNDER MN UNIQUE AND UNJUSTIFIED LAW, the nursing home is ABLE TO AVOID LIABILITY even if the nursing home KNEW its employee was dangerous and failed to protect the resident from him/her (YES, THIS HAS HAPPENED).  If the nursing home and its employee can DRAG THE CASE OUT LONG ENOUGH, they might just get lucky if their victim dies of unrelated causes before the legal case can be completed.  

Lawyers many times will NOT take these cases due to the fragility of the victim knowing the case dies with the victim if that should happen before the case is settled.  This means the the LAW UNFAIRLY DISCRIMINATES against the elderly.  It FAILS TO PROTECT the interests of MEDICARE AND MEDICAL ASSISTANCE that pay for the services.  They are entitled  to recover a significant portion of the amount paid for the victim's medical expenses.  

WHY WOULD MINNESOTA'S LAWMAKERS CHOOSE TO PROTECT WRONGDOERS from paying for the harm they cause? Whose interests are they trying to protect at the expense of injured elderly citizens? Why should TAXPAYERS have to foot the bill? What is this unjustified law from the 1800's?

Current MN Statute 573.01 states: "A cause of action arising out of an injury to the person DIES WITH the person of the part in whose favor it exists, except as provided in 573.02.  All other causes of action by one against another, whether arising on contract or not, survive to the personal representatives of the former and against those of the latter."
