Without actual separations between sections, people sitting in the "non-smoking" section are able to inhale and be bothered secondhand smoke just as much as if they were sitting in the "smoking" section. Also, because of the design of the restaurants, food and food products can be contaminated during preparation by exposure to secondhand smoke; dishes, utensils, cups, and glasses are also exposed. Patrons have the right to breathe clean air and expect untainted food and eating surfaces.
