The Issue

My name is Teresa Bogans , the daughter of Samuel and Betty Beeler. Both my parents have since passed. They had hired you to represent my little brother, La'Bar Beeler, in the Culpeper court for a sentence reduction in 1999 and you also did his state habeas corpus which both were ultimately denied. La'Barry has informed me that the current Virginia governor, Ralph Northam, is also a medical physician and his experience as such may be helpful in understanding his case. If you remember, La'Barry had willingly pled guilty to a homicide and the judge sentenced him to Life imprisonment. The issue the judge had was that the defense counsel provided no reason as to why La'Barry did this. When you were hired you had Dr. Sellman evaluate La'Barry which brought up some known side effects of the SSRI he was taking for depression called Paxil and that it may have cause him to commit homicide. But that, most importantly, it would have provided the judge the answer he was looking for before sentencing him, and may have mitigated the severity of the offense and sentence. Well, three years after La'Barry's case ended, the makers of Paxil, SmithKline, lost a lawsuit in which they hid other adverse side effects of Paxil which, in some individuals, will cause a person to commit homicide. Donald Schell, who took only two doses of Paxil, just like La'Barry, killed his entire family and himself. His surviving family won the lawsuit against Paxil which now has the "black box" warning due to it being one of the most dangerous drugs approved by the FDA. La'Barry is in the process of asking the governor for a commutation of his sentence and feels his background as a medical physician will help him understand the reason this tragic event happened due to Paxil.
