VIOLATIONS OF ARTICLE II, SECTION 2, CLAUSE 2 - STOP THE CORRUPTION
The Issue
Petition to the Executive Branch of Government of the United States of America
We, the Undersigned Citizens of the United States of America, as “We, the People,”
Whereas, the Constitution of the United States, under Article II, Section 2, Clause 2, unambiguously vests the power to appoint principal officers, including United States Attorneys, in the President of the United States, with the advice and consent of the Senate;
Whereas, Sean P. Costello has served as the purported United States Attorney for the Southern District of Alabama since February 27, 2021, without nomination by any President or confirmation by the Senate, in direct violation of the aforementioned constitutional provision;
Whereas, this appointment was reportedly made by an unelected United States District Judge, Kristi K. DuBose, exceeding judicial authority and usurping the exclusive powers of the Executive and Legislative Branches;
Whereas, any statutory provision, such as 28 U.S.C. § 546(d), that purports to allow such a judicial appointment is repugnant to the Constitution and therefore void, as established in Marbury v. Madison (1803), where laws contrary to the Constitution are null and void;
Whereas, Sean P. Costello’s tenure, now exceeding 1,648 days as of August 22, 2025, cannot be deemed “temporary” and constitutes an ongoing usurpation of a principal office, rendering all actions taken under his authority void ab initio;
Whereas, this unconstitutional and unlawful occupation has allegedly led to abuses of power, including the targeting of citizens, fabrication of cases, and violations of constitutional rights, harming families and undermining public trust in the justice system;
Whereas, no individual is above the law, and the Executive Branch has a duty to uphold the Constitution and protect the rights of the people;
We, the People, hereby petition the Executive Branch, including the President of the United States, the Attorney General, and the Department of Justice, to take immediate action as follows:
1. Remove Sean P. Costello from his position as United States Attorney for the Southern District of Alabama without delay.
2. Initiate a full investigation into the circumstances of his appointment and tenure, including any potential criminal acts, conspiracies, or violations of federal law committed by Costello, associated Assistant U.S. Attorneys, federal judges, magistrates, attorneys, and FBI agents in the Southern District of Alabama.
3. Nominate and seek Senate confirmation for a lawful United States Attorney to fill the vacancy in accordance with Article II, Section 2, Clause 2 of the Constitution.
4. Review and vacate all convictions, sentences, and actions taken under Costello’s authority that may have been tainted by this constitutional violation, providing relief to affected citizens and their families.
5. Ensure accountability for all involved parties, applying the same force of law that would be used against any citizen committing similar acts of usurpation or abuse of power.
We demand swift and transparent action to restore constitutional order, protect the rights of the people, and reaffirm that no one—regardless of position—is above the law or the Constitution.
