The Issue
Centre Canin DogScouts was given a 30 day notice from the city of Montreal, last week, to cease daycare operations or face fines and be brought to municipal court.
Their initial argument was that the ground floor of our building was under class C2 while the top floor was classified as C2H-A. This would mean that our daycare space would be considered as residential. We recently confirmed with the city that they have us registered as a class 10 non-residential lot and that our building has had the acquired right to remain commercial since 2008. After clarifying this, the city then said the issue was that we were keeping dogs outside and received complaints from neighbours.
When asked for documentation of these complaints, we were refused proof. We have never received a fine, a warning, a notice or even a visit from the police.
An inspector from the agricultural department for the government of Quebec spoke to us about zoning before we opened. He said a dog daycare was permitted in the area as long as we operated during regular work hours and did not keep dogs overnight. We operate from 7:00 am to 6:00 pm and do not board dogs at our location.
Now we are being told it is illegal for a dog daycare to operate in this area. We made sure to place our daycare in the same zone as DoggyDay NDG, a daycare that operated for over 5 years without issue. They were located at 6131 Sherbrooke W, while we are 6244 Sherbrooke W.
We ask that you now join us in signing this petition to encourage the city of Montreal to change their decision and allow us to continue operating as usual, without having to relocate from 6244 Sherbrooke St W.
