UT Attorney General Reyes: Listen to your Fellow A.G.s and Drop the Public Lands Lawsuit!
The Issue
“I do solemnly swear (or affirm) that I will support, obey and defend the Constitution of the United States and the Constitution of this State, and that I will discharge the duties of my office with fidelity.”
The Attorney General is the State’s primary legal advisor. His duty is to the Constitution of the United States, the State of Utah and the citizens of the State, not to the State Legislature, the Governor or to his political party.
In an 11-1 vote, Attorney General Reyes’ counterparts in the Conference of Western Attorneys General have decried as unconstitutional attempts to take public lands from the Federal Government, as is being pursued by the State of Utah. This comes after the Legislature’s own lawyers warned that such a move would have “a high probability of being declared unconstitutional.” Only the Utah Legislature and the out-of-state law firm that stands to charge Utah taxpayers $14 million believe in this lawsuit.
Utah’s efforts to steal away our public lands is not only legally foolish, but it is also financially unsound. Although economists predicted Utah would be able to afford managing these vast new swaths of land, they did so assuming oil prices would remain high and drilling would increase - two assumptions that have already failed.
Every day, the Utah government’s pipe dream of taking our public lands from the federal government is shown to be un-winnable and the waste of taxpayer money that it is.
