  Mr. Shawki Ahmad Omar, an American and Jordanian national, has been imprisoned since 2004 in Iraq. After being detained and tortured by the Americans he was turned over to the Iraqis who have since 2010 detained and tortured him. He must be released immediately as he never committed a crime. By this Petition we, the undersigned, call for his immediate and unconditional release and for him to be compensated for the grave injury he has suffered.     Mr. Shawki Ahmad Omar  was detained in Iraq in October 2004 by the United States forces. He was sentenced to 15 years’ imprisonment in 2010, which was later reduced to seven years, for having entered Iraq illegally, even though he had the legal entry permission in his American passport which the United States military confiscated from him. Even with his unlawful sentence he should have been released in 2011 has he had been held since 2004.   On 23 April 2014, the United Nations Working Group on Arbitrary Detention found that Mr. Shawki Ahmad Omar was being arbitrarily detained in violation of international human rights law applicable to Iraq and that he should be immediately released and compensated. A/HRC/WGAD/2014/5)   When Mr. Shawki Ahmad Omar was detained by the Americans he was tortured with electric shocks, beaten, choked, hung by his wrists, water­boarded, and subjected to sleep deprivation during interrogations. His wife Narmeen Saleh al Rubaye  was also tortured even though her torturers knew she was several months pregnant. Although She was released after 16 days without charge and later fled Iraq, Mr. Shawki Ahmad Omar was been held without charge, without trial and without access to his lawyer until 2010, when he was convicted of entering Iraq illegally in a process where his captors conceded exculpating evidence. He has trial has been determined to be unfair and his detention arbitrary in violation of international human rights law by the UN Working Group on Arbitrary Detention. Mr. Shawki Ahmad Omar has serious health problems as a result of his detention and has been disappeared since late 2013. Efforts to encourage the United States government to assist him have been unsuccessful. We, the undersigned, demand that the US government seek his immediate release and hold those responsible for his detention and torture responsible.
